Hi all,

I came with an H2B working visa, then I changed it to a B2 visa, however I violated my visa by using my SS to work while I'm on a tourist visa.

Right now, I'm in a serious relationship with a male to female transexual. She has changed all her papers except for her birth certificate, so she's legally male according to her birth certificate. She's a full time student so we were thinking to ask her roommate to joint sponsor me. Here are some of my questions

1. Can we get married and if we can, what should we do?

2. What documents does she need to file for me?

3. Given to my violation, will it hamper my chance of getting my status adjusted?

4. And is it necessary for her to pretend as a male for 2 years (temporary to permanent green card) and while we file until our interview?

Hi there and welcome. I guess my first question to you is are you male or female (sorry, didnt see it in your response). Regarding question 2, look at the guides at the top and they list what documents are needed. The AOS documents also have fairly comprehensive directions, so make sure to read them carefully. Q3: Usually overstays etc. are forgiven when you marry a USC and file for AOS.

EAD/AP approved Nov 26 '07

Got the AP Dec. 3 '07

AOS interview Feb 7th (5 days after the 1 year anniversary of our K1 NOA1!

Stuck in FBI name checks...

Got the GC July '08

What is your gender? You're in the USA. Check with your local County offices about a marriage license. If they say yes, you can marry but probably only if you are female. Not sure how the officiant is going to verify he's marrying the two people named on the license but let's not go there.

Check with a lawyer about the ramifications of your immigration law violations.

Never lie to an immigration official. The consequences are not good.

Hey great help there. :rolleyes: This does happen. I think in this case it would depend on the state you are living. If same gender marriages are legal.

Being allowed to marry and adjusting status based on your marriage are two different animals.

First off check your state laws for marriage. Secondly, have a consultation with a immigration attorney to decide the best course of action for your case.

Hey great help there. :rolleyes: This does happen. I think in this case it would depend on the state you are living. If same gender marriages are legal.

Marriage laws vary by state but a spouse or fiance visa requires the parties man and woman. No same sex fiance or spouse visas are granted. That's why the first two questions were meant to determine the legal gender of each person involved.

If the OP is a woman, the visa can happen. If the OP is a man, no visa but perhaps marriage. The transexual is a man.

Someone correct me if I am wrong but: Even if the state recognizes same sex marriage, it is written into the Immigration Act that the spouse must be of the opposite sex?

I know we don't know the poster's gender yet, so this might be moot. I am just curious.

I have heard of this occurring in Britain. So their laws must be much more different. Katoeys are a common thing in Thailand.
