It is long time I didn’t post here. You may will see my name Happy Man, but I am not any more happy.

To make long story short…….I am married with an USC since January 2004. My wife applied for my CR-1 visa and I got my visa last week from Casablanca.

Our relation was very nice, loving and cordial but suddenly starting of this month I found that my wife is trying to avoid me……………I asked her whether any problem…………she told no problem……………but 7-8 days before she sent me an email and told me that she is confused and not in love with me…………….but she didn’t mention what is my fault……………..to be honest after our marriage I never did any wrong with her………I loved her…………I respected her……………as much as possible I take care to her…………………we talked online daily and over phone too. I surprised to see very suddenly she changed her mind. I can’t believe it still!!!

Any way, I contacted with her few friends, whom I knew by her, she introduced me. I asked them why my wife acting like this…………..they found that my wife is now contacting with another guy and before 3-4 years she was in love with him even she applied for him K-1 that time and got denied . The guy from Algeria. After 2-3 years the guy sent her an email and told her that he miss her too bad and he wants to be with her again then she sent reply that she is feeling same……they started online chatting and this is the reason she is avoiding me.

Now my question :

Can I still enter to USA by my CR-1 Visa?

If she wants can she cancel my CR-1?

Do I have anything to do, any suggestion?

I really love her and miss her too bad, I want to be with her.

Please give me your valuable advice and your advice or suggestion will be highly appreciated

Ohhhhhhhhhhh I am so sorry to read this unhappy story.

It's difficult to comprehend how heartlessly your wife has treated you. You deserve much better than that.

As far as your visa, I believe you can still enter the U.S. with it. I don't think it can be "cancelled" by your wife now that it's already issued. She can initiate divorce proceedings if she wishes, but I don't think that will affect the status of your visa. (Someone correct me if I'm wrong here.) You have 6 months in which to travel; however in your case it might be better to make it sooner rather than later.

If you have an IR-1 visa, you get a 10-year green card. A CR-1 visa is "conditional" for 2 years, so you would have to adjust to "permanent" status 2 years after entering the U.S. Usually a couple appears together at the adjustment interview, but it is sometimes possible to adjust without the U.S. spouse in cases of divorce. I have seen a few cases discussing this circumstance here on VJ. There are other VJ members who could probably advise you.... perhaps Meauxna or Yodrik may know the specifics. Try posting your question in the CR-1/IR-1 forum.... a lot of people don't enter the Middle East/North Africa section, but might answer you there.

Again, I am very distressed to hear of such an unhappy turn of events. My thoughts and prayers are with you.

If she wants can she cancel my CR-1?

I think she can stop you from coming if she calls the consulate or the DOS. This is a real tough issue. I do believe she can cancel the CR-1. I have heard of this being done before. I don't even know what you can do to find out.

Have you called her and asked her? That is what I would do. Ask her if she wants you to come here. If she doesn't want you here, then why come? You will be all alone here.

If you've been married for over two years now; why would you get the CR-1 Visa just last week?

I have a friend in the same boat, that is - waiting over two years for a CR-1 visa. Blame it on the Moroccan consulate. I certainly hope that when my friend's husband gets his green card eventually it turns out to be the 10 year one. They've waited way too long to be together to have to go through any more dealings with USCIS.

Not to be the cynic here because we don't know your wife's side of the story, but why would you still want to come here knowing ur wife doesn't want you anymore??? Obviously if ur wife doesn't want you anymore and seems to me she would have took precautious at the embassy level to prevent you from gettting ur

CR1 visa. I think ur story just sounds strange to me, but that's me. :unsure:

I am not sure you will get much help here knowning a lot of k1/k3 going thru morocco are getting sent back because they think their relationships are not true, and maybe because it's cases just like yours that are at fault. my .02

We've been married for over two years and have yet to get the visa ....

It's called immigration ... and it's very real. :blink:

I agree with angel ... why would you still want to come knowing you have nowhere to go or noone to turn to ? If it was me I'd rather stay in my home country.

Reunited and it feels so good ....

NOA #1 - March 23rd, 2004

Interview- May 18th, 2006 (Success !)

Arrived in the US - May 27, 2006 (our IR-1 visa journey was 2 years and 2 months long)

Wedding - June 17th, 2006

It's a Girl ! Baby Hana's expected due date - March 30th, 2007

Although this whole story seems a bit strange, what it boils down too is if you have been married over 2 years like you stated you will get the IR1 visa not the CR1. there will be no need to prove you marriage is valid after 2 years. I don't know if she can stop you before you come to the US, but I do know that once you are here there isn't anything more she can do. Maybe if she had some sort of proof of fraud, but I even question if that would be enough to stop you.

oh im sorry for what has happened. I must say you sound like a dear man and your woman has not cherished that. She has been inlove with another man and he left her and now he wants to come back to her it all sounds so suspicous. But you know god lets you know things that are maybe for the best. I know you will find what you looking for. Im sorry for what you going through now it makes me cry.

once its been visa is issued its yours. far as I know once its been issued she cant take it away from you. you can certainly enter the usa. :thumbs:

once its been visa is issued its yours. far as I know once its been issued she cant take it away from you. you can certainly enter the usa. :thumbs:

IR1 10 year green card.

Hi Happy, first off.. I'm sorry to hear about what happend. Did she really think that she would be able to bring the Algerian guy on a K-1 when she's already married? Not too bright to begin with.

If these friends of yours were real friends, I dont know why they wouldn't have told you right away :(

But... now that you have the visa, if she has not attempted to cancel it... you have the visa, you're free to come to the states.

Sorry that this is your first bad experience and you haven't even hit American soil..

Am I the only romantic here? I know what she did was totally wrong, but if he loves her that much maybe he should try to win her back. Long distance relationships can be very trying and make people do crazy things. I'm not justifying her actions in any way at all, but they are married, so maybe they can work things out. :huh:
