Filing while she is visiting in the U.S.

I-129F question 12:

If your fiance is currently in the U.S>, complete the following: ...

How does this affect the application? I was considering filing the I-129F while she is here on the tourist visa waiver, about a month before she returns to her home country. Will this cause any trouble? Is it easier/better to just wait until after she returns to file the paperwork?

It doesnt matter, you can file while your fiancee is in the US.

NO the sooner you start to file the sooner you will get an interview!

I AGREE ... FILE, FILE, FILE.....

We were totally under the impression that we couldn't file while I was over there... so we held off for almost 2 months and waited till I was flying out of the country before it was posted.... only to discover (LOL... since then and the good threads here at VJ) that we COULD have filed during my US stay...

Man oh man... 2 months... that would make a huge difference on all of the lengthy delays we are going through now...

So FILE I say.. <grin> FILE...

Just make sure you fill in the section on the I-129F that asks if they are currently in the USA what their I-94 number is and the date they are leaving.

20/11/2007 Went to police station for fingerprinting and National police check

4/12/2007 Police called police & fingerprint check done and ready for my collection

(getting ahead of myself I know <grin> but want to get everything ready

and organised - so MUCH paperwork/costs when there is me AND kids involved)

13/1/2008 - The estimated date on my timeline for adjudication NOW SAYS 21st March... OUCHIE..

29/1/2008 - WOW the estimated date on my timeline NOW says 7th April.... COME ON FOLKS.. PLEASE UPDATE YOUR TIMELINES IF YOU HAVEN'T DONE SO... your updates help give number crunchers like myself something to gauge. 4th feb - all these approvals MUST be doing something, my timeline NOW says 2nd April...

5/2/08 - YAY YAY YAY.... NOA-2 approval via email from CRIS... WHOO HOOOOOOOOOOO.... the "estimated timeline said 31 March this morning just as an FYI for you all)

9/2/2008 Flying to Ohio to spend a bit of time with my darling man to arrange our wedding and also just to spend some time together :-)

......

31/5/2008 Our Wedding day (we think) <grin>

The USCIS is just looking for people that might be trying to enter the US but have been living here illegally or perhaps lied on their tourist visa application. Just make sure they return no later than the date of expiration of their visa. Honesty is not a problem with the USCIS. Understand that the visa is only issued in the foreign country and the fiance/fiancee must be present at the interview.
