before I go and sue USCIS.. hopefully something will get done.. I faxed some more congressmen (of California) and also the two senators, and also Governor Terminator :thumbs: .. maybe they will help me?? I even told them it was past 210 days already for me.. this is taking WAY TOO LONG just to get approved (even past the 1st step).. just take a look at my current estimate in my forum signature and you can see... :crying: :crying: I didn't want to do it, but they leave me no choice.. I am giving them another 2 months to get their act together...

I received a response from the Congressman Office today. So, what this is worth we are also continuing the wait!

Everything about this entire process is just screwed up!! In addition the Lima Peru Embassy closes Dec 14, and reopens January 2, 2008. USCIS has scared and tortured us every possible way! Also, my K3 is on hold because of this DAMN RFE! On November 20, 2007 its six months from the NOA I date and not the received date which is even longer.

We have lost 7 weeks because USCIS did not know if I was the same person as my maiden name. Our lives remain on hold and will spend the Holidays seperated because of stupid ###### like this! But, these damn people will share their holidays with their families! I know I have stated in an earlier post but, USCIS will process our applications at the very last minute and have intentionally kept our applications pending! Not fair and is totally unjustified for one document! :angry::angry:

But, here is what the Congressman's office sent today:Kim,

I received a response from the California Service Center indicating that you should receive a response by the end of November. I will continue to follow up.

Don't give up.. we are almost there My Honey.. I have sent a whole package to each congressman/senator/governor and also to their various offices (11 people, but over 25 fax numbers).. (3 pages, 1st page -- Authorization Form, 2nd page -- whole page stating my situation with priority dates, working for the government, other people processing / approved before us, and March people can come in October while we are forced to wait, and 7 months without touches, and also these ##%*%# security checks)... hopefully they will respond to my request soon (just like you)...

Wish you can get past this step as soon as possible... Although they should have written more than just a one-liner.. :whistle:

I spoke with my husband last night and our deadline for USCIS we both agreed on was end of November. Otherwise, I was proceeding on to the next level. This truely is unacceptable and processing applications at random when the NOA receipt clearly indicates USCIS processes applications in the order they receive them is bullshit!

Our K3 was transferred to CSC and it states:

This is to advise you to speed up processing we have transferred the above case to the California Service Center for processing.

Our I-130 should have NEVER been transferred to CSC. I live on the east coast and our applications should have remained at VSC. Otherwise we would have already would have been completed this DAMN process! I have no more patience and this waiting game is CRUEL!!! We are American Citizens and I want to know where are my rights and what about the 6 month uniting families together? Our ENTIRE SYSTEM IS BROKEN AND SUCKS!!! These people are our families and they are not terriosts! Actually we need protection from USCIS actions for mental cruelity! :angry:

I used to think the same thing about being transferred to CSC from VSC. People who mailed in around mid May and June were getting approved so fast out of VSC for a while and we were stuck waiting at CSC because we got transferred there before they were freed of the H1b backlog. Unfortunately, we haven't seen many approvals out of VSC lately either.

As for your approval, I hope you get it soon. They claim to try to finish processing petitions within 60 days of resuming processing after an RFE. In a different life, when I was RFE'd on a K1, I heard nothing after they resumed processing. I called them on day 60, and they looked at it and said, "oh, actually we are mailing something out today" and I did receive the NOA 5 days later.

Desperate times call for desperate measures.. I found some numbers from inside USCIS that some people might not know.. does anyone know the Director's fax number? I have been on Google, and nothing yet.. Last time the USCIS person gave me a fax number, but it might just be for their department (and not the Director's personal fax number)..

Thank you Urge for your response. I hope to God we are approved soon. USCIS waited 6 months to review our application then required the additional information. Which I was fortunate to receive a fax from USCIS on October 9, 2007. I swear the only reason I received this fax is because I spoke to an "Angel" answering the telephone that day. The fax truely was a miracle! But, I overnighted the document and confirmation from the Post office was 10/11/2007. But, USCIS took additional 11 days to input the received information into there system which was 10/22/07. So, technically speaking USCIS recognizes the document from Oct 22, 2007. When we killed 11 days plus waiting the additional 60 days waiting from Oct 22, 2007. The total picture to complete the I-130 is now at 8 months and 11 days. Which is real close to 8 1/2 months to finalize one application from CSC. Totally unacceptable! Also, the RFE is for one document which is my ex marriage license to prove my maiden name. I did have my birth certificate and my divorce decree enclosed from Pennsylvania. But, unfortunately Pennyslvania does not have your maiden name on the divorce decree only on the ex marriage license.

Also, from the very beginning in completing our documents we were advised our K3 will be processed faster than our I-130. But, our I-130 was reviewed first and RFE issuied and the k3 remains on hold until this is resolved. Truely, this entire process has been ### backwards! We have all been misinformed and delayed and I feel USCIS has now attacked my character. Why would I send them a birth certificate that would not be me? I totally understand there is not honest people out there and would try anything to get by. But, the dishonest people will take the fall! We are being punished and our application is delayed and it would seam to me after USCIS has my social security number they could pull any amount of information on me. Its extreme and I understand we need regulations but, this has gone overboard! Honestly, even with the email I received from the Congressmans office I do not believe anything until I receive our NOA2 hard copy in the mail. USCIS has really put a bad taste in my mouth...

I still believe if our application would have stayed at VSC we would have been at our interview in Lima and I would be with my husband. Who I need very much in my life! Also, the K1 would have been the better option. But, I can't look back now because that is only dust in the wind now...

If this is an Organizational chart normally they are telephone numbers. If they would be faxes it should state fax but, this is very interesting and I would say you have been doing alot of research my friend.... :blink:

so I also faxed to the US Attorneys in California (3 of them) asking for their help.. also updating my letter stating that "further action will be taken (writ of Mandamus) if this is not resolved soon. (I will be giving them a deadline of 1/1/2008 -- 260 days).. I even wrote all that... 260 days... that is 8+ months just to get approved... plenty of time for them to act on... if I do get denied, I will see them in court (so it doesn't really matter)... best for them to approve me (just like so many Visajourney people on here)... :angry:

next up, I'm going to fax over and use ATTN:xxxxxxxx for every one of those people on that organizational chart =) There's more to come USCIS... congressmen, senators, governor, US Attorneys... until you approve my visa application... I really don't see a reason not to... :angry: I sent almost 20 pictures when I applied for I-130 (in different categories too)... pictures of both parents , pictures of me and her parents, pictures of her and my parents..

woo... Attorney General of California.. didn't see that..

I did see your first post. But, just be careful on your wording with these people. I totally understand your pain and frustration! But, I really believe they will hold things against you. USCIS will look for anything to deny an application. These people I believe are very spiteful and cruel! The bottom line is there is no justified reason for these additional delays. We should all be in the same place as our other VJ members! Not waiting for additional security checks or if I'm the same person! I now your energy levels are very high because this truely makes me angry and bitter as each day passes... But, keep in mind my friend your wife is waiting in the wings and if your intentions are to make your home here in America; make sure your all your ducks are in a row! Also, to USCIS we are only a piece of paperwork in their eyes. But, this is our life and our spouses.. :)

I wish you the very best for our applications to be approved and released from CSC!!! :thumbs:

Well Gogo, I'm right with you!! When the going get tough the tough get going.... This is our families and yes we are being attacked at all angles. I want the hell to end... :yes: Our rewards when this closes is forever and priceless... The word WAIT

turns my stomach inside and out! No person has to speak to me of patience and wait. If you didn't truely love your spouse in the process; you would have never had the strength to continue on. My husband is my strength and life. I thank god everyday for him and how I appreciate him! I am waiting to put this hell and nightmare behind us and live a normal life just like everyone else.

I think the appropriate steps would be what you did, contact your elected representative and let them sort it out with the USCIS.
