Immergration Visas from the UK

I am enquiring if anyone can help me. I have a girlfriend who is a US citizen and she is moving back to the US with her family. We are engaged and I am wondering what I can do to move back to the US with her. Please help! :help:

The fastest and best route, unless you want to marry her tomorrow, is for her to file for the I-129f to get the fiance visa for you. That would take about seven months, and you would need to get married within 90 days of entering the US.

Assuming she has lived in the UK on a resident-type visa for at least six months, another option would be for you two to get married ASAP, and for her to file the I-130 petition at the London USCIS office. That would get you an immigrant visa (much better and a cheaper process than the K1 visa) within about five to six months.

When is she moving back to the US?

All the responses have been right on the money if marriage is in their immediate plans, but I can't help but think the poor guy asked about immigrating with his girlfriend when she returns to the US with her family and immediately there's all this talk about marriage and/or marriage right away, like tomorrow.

I mean, no flowers, candy, or dinner first, just hit me with the "M" word right between the eyes. LOL

The fact is, there is no provision in US immigration law for a boyfriend to immigrate because his girlfriend's family is returning to the US. In case marriage plans now would be premature for this couple, the alternatives are a bit limited. His best other bet would be to pursue an F1 student visa, if applicable or an H1B work visa. The H1B would require an employer sponsor etc. He can look into the requirements and procedures for these other visas and see which, if any would apply to his circumstances.

Otherwise, look forward to visiting as often and for as long as circumstances allow.

Well DannyDavey, you'll have gathered from the above posts that the options are get married now, or get married later if you want to persue permanent residency through your relationship with your girlfriend.

Like many of the above, my advice is that you get married sooner rather than later. You only need to have the civil ceremony, you can do the 'real' thing later if you want to.

Applying for a CR-1 while your girlfriend is still in the UK qualifies you apply directly through the embassy - DCF - bypassing the lengthy USCIS/NVC processing, it would probably take 4-5 months.

Going the K-1 (fiance) route not only takes longer for the visa to be issued, but these days AOS to permanent resident is taking a very long time. I suppose if your girlfriends family is there too, you would have support so it wouldn't be as hard for you as it is for others, but in anyone's book, AOS is expensive and a pain.
