I just wanted to say that I agree 100% with Kez :) If there is no intent at entry, it's not visa fraud and they shouldn't have many problems adjusting unless the IO suspects visa fraud - in which case, it appears there is proof to back up the claim that there wasn't intent at entry.

As for being asked to prove intent - many, many people are not. We weren't, but my husband had also overstayed for 5 years, so that may have had something to do with it.

The OP started the topic with the word intent that is why VJ members is confusing with their opinions. I think the word "intent" is not right for adjusting status.

golfer1 if you really have no intention of staying in US upon arrival,well then it is not a "fraud" you can adjust status from B2 visa.

if you are feeling guilty about your k3 application,well dear, you need a strong explanation to USCIS to dismisssed the case.

If I were you...I will just try AOS because there is no harm in trying.You just have to accept the fact of what will be the decesion of the USCIS. You have to gather evidence and proof of your case.

Even today he had a bit of a rough opinion in a thread here. He seems to be a bit jaded, and off his rocker.
