Yes, but that doesn't explain who called for it which is what I am interested in. To me, if the call came from law enforcement, I am more inclined to believe that it's a necessary device than if the call came from a politician.

Expounded to add that I read Lisa's comments in the light of sex crimes exclusively which is not the case. The U visa doesn't change the parameters for how anyone is treated in terms of the criminal process. It isn't a cushion that protects someone against the personal effects of testifying in criminal proceedings. It doesn't stop the defense from raking them over the self same coals.

But you've missed my point again.

Well, explain it to me if I missed it, gahh doesn't really help.

Dev, I have googled, I have found the act it came from, I am still searching but I have as yet failed to find out where the motivation from this act came from. If you have found it, can you please at least provide a link? I am genuinely interested in this point.

The U visa was a key provision of the Victims of Trafficking and Violence Protection Act. The new visa elated immigration advocates, even though its main impetus was to give law enforcement officials a tool to keep undocumented victims and witnesses of serious crimes in the United States to testify or otherwise cooperate with authorities. Legislators designed the visa for foreigners who could prove that they had been victims of a crime in the United States, had information about the crime and had helped or were willing to help authorities investigate or prosecute the case. Applicants have to submit a personal statement that is backed by a form signed by a local or federal law enforcement official.

It seems clear to me that this whole dispute is about whether the U visa is a 'reward' or an instrument of justice. If you think it's a reward, then there really is nowhere else to go. Civic duty? Crikey, are there any other nails you want to put in their coffins?

Now that you mentioned it ... yes ... illegals aliens have a civic duty to report for deportation.
