meh.. if the boy were a USC everybody would be extradite them now! but since hte kid is an illegal. noone gives a sh!t about him, cuz probly he's lying, he's just in it for the greencard, and all illegals are gonna follow him

Are you suggesting that you know of some reason why this case is not eligible for the U visa? I don't know why you would quibble otherwise. That's always assuming the crime wasn't reported in the first place on the understanding they would be eligible for the visa.

Greencard/immigration issues aside -- the fact is that this 'relationship' cannot be considered equal hence consensual. As educators we abide -should- by strict ethical codes of conduct when it comes to what most faculties call "dual relationships". That is, if you are someone's professor/teacher/counsellor, you should not have a relationship. Ta-ta. In some instances, this has called for having tenured professors thrown out of their departments, or be highly reprimanded by their Department Chairs (my own supervisor got shite for doing this and had a really hard time until he married the lovely girl in question -- who was/is my age ---not me, I could barely work with his arrogant French azzzz, but he was the best prof there's no doubt there).

Power is not equal, and that who holds the power can influence the behaviour of the student/patient. This is not something I made up this morning: it's well known amongst educators that such relationships are off bounds; EVEN in higher education settings where both parties are adults. Heck! Even when if you are a teaching assistant, you cannot/should not date or socialize with your students until the semester (and the unequal teacher/student duo) has ended. When it comes to teaching children/teenagers the issue becomes even more relevant and no, there is no hiding behing the "Well he/she is 16, she'he knows what their doing" -- it's unequal from whichever perspective you look at it. If you're in love (and it happens), freaking wait until the semester/year/session is over.

How may people do we know that were either granted A+ when they were really deserving a flunk; or viceversa: being flunked because you had the cojones NOT to respond to the professor/teacher's advances. And like almaty said: if this was a woman we would all be cheering for some sort of genital excision.

Those are my 3 cents when it comes to teaching and ethics. As per the immigration part of it I choose not to chip in the discussion.

What's with the race card flip comments?

This is a case of illegal sexual relations. It's illegal because the boy was 13, well under the age of consent. It's illegal regardless of any so called 'consent' that the boy may have made because he was 13. If his case complies with the requirements for the U visa, then he will get that if the case is successfully prosecuted.

Some here are looking for a way out of the illegality of the sexual relations. Why are they doing this? I have no idea but one has to wonder what the comments would be if the teacher had been the illegal alien and the underage child the USC.

While we're at it, we should remove all protection to illegal mexican women who are victims of domestic battering. They're illegal so it's aiight to beat 'em up. Heck, it's encouraged - yeehaw!

I would imagine it would be extremely hard for an illegal to gain a position as a teacher, of course, forged papers notwithstanding. However, forgive me for not being entirely convinced that the level of skepticisms regarding whether this kid 'knew what he was doing' in this this case isn't just a little tied to the fact that this kid is not only an illegal, but also an illegal mexican.

A teacher goes through more than a 'papers' check, I assure you. Forged papers would not get someone who teaches minors far.....

no wonder no one wants to be a teacher anymore. They are going to have to start teaching classes in pairs, and they don't have any control over the class.

another thought is how come it is so easy for anyone to register in school? How come this kid was even in a school here? Are USCs paying taxes so that anybody can go to school, regardless if they are here legally or not? Maybe that would help cut down illegal immigration, if there was not education readily available to anyone who walks in.... just a thought

Yes, there is most definitely access to free education in the US. In my school district, you do not have to prove US Citizenship to go to school. In addition, there are also teachers specifically for the (now overflowing) ESL classes.

Dev, shouting loudly doesn't make what you say true. The woman was in a position of power over the boy and the law is quite clear that a boy of 13 isn't capable of the rationale to understand the meaning of this type of relationship.

Either you accept that precept, or you don't, in all cases.

Are you saying that in your opinion a 13 year old boy is capable of making these kinds of decisions so that the law is wrong? Or, are you saying that some 13 year old boys are making these kind of decisions so the law should be changed to accommodate these cases? (bearing in mind, that if you did fudge the law in this way, it would make the prosecution of any adult having sex with a child extremely difficult)

The law is quite clear, if you are under age, you can't make these decisions, period.

I could care less about this jerk. He will now get LPR, cuz he was 'lucky' enough to (willingly) shag his teacher & go on a vacation with her. Too bad he was 13 so he cannot legally 'decide' for himself. Oh well, no worries - she will be prosecuted & he gets to stay legally in America. What a nice loophole.

MaryKay Letourneau married her 'abusee' & his family's case against the school district for not protecting him was thrown out. But I see everyone has (conveniently) glossed over that part of the thread.

1. I teach 13 to 18 year olds and I have 2 children. Perhaps he made his decision based on hormones, but having taught this age group for nearly 10 years, my personal experience is that a child this age is susceptible to his teacher's "charms" and probably can't be held accountable...but.. opinion/butthole.

2. Mary Kay is from my neck of the woods. There is SO much more to this story than you are summarizing here. He was also left with children and completely ostracized in his community. I don't think these can be equated here. Maybe, but not from what I've been told.

I have done extensive research on MKL as well, I worked on one of the movies. So yeah, I'm aware of what actually went down.

As I said, more than a little of the motivation for looking for a reason for this child to be looked on as an adult in this situation is linked to the fact that he is both illegal and mexican. If that's called pulling the race card in your/others eyes, then fair enough, I'm pulling it.

I'm just saying that there are differences in these two situations. Regardless of your knowledge, if you haven't lived in the community and worked with or talked to her colleagues, I don't think that you are in a position to compare.
