The Devil Inside diz (11:15):

how is your visa stuff going?

Denise diz (11:15):

terribly slow :(

The Devil Inside diz (11:15):

i know it sucks...im going through the same thing with my wife..except i have residency in her home country

Denise diz (11:15):

i was just reading this

Denise diz (11:15):

http://www.washingtonpost.com/wp-dyn/conte...7102801706.html

The Devil Inside diz (11:15):

they told us that my wife's would take 6-8 weeks

The Devil Inside diz (11:15):

*reading*

Denise diz (11:16):

btw, visajourney.com is pretty useful with information on spouse visas

Denise diz (11:16):

6-8 weeks?

Denise diz (11:16):

are you getting a k-3?

The Devil Inside diz (11:16):

yeah....belgium is the seat of the EU, thats why

Denise diz (11:16):

i heard that it didn't matter

The Devil Inside diz (11:17):

I-150, i believe

Denise diz (11:17):

there are lots of people from canada, england, france... countries that have very solid and friendly relationships with the USA, and they're all in line with the rest of us

The Devil Inside diz (11:18):

no idea why its faster here....getting my belgian residency was alot harder

The Devil Inside diz (11:18):

we arent rich, either ;)

Denise diz (11:18):

what is the I-150 visa? it´s not a spouse visa

The Devil Inside diz (11:19):

hold on ill find it..i dont remember the numbers lol

The Devil Inside diz (11:19):

yeah its k3

The Devil Inside diz (11:19):

i gave the number of some form i had to fill out :P

Denise diz (11:19):

i find it very unlikely that she'll get it in 6 weeks :(

The Devil Inside diz (11:20):

so far, everything we have done has been on schedule, actually

The Devil Inside diz (11:20):

we are waiting on some paperwork from america (for me), before we finish everything

The Devil Inside diz (11:21):

what sucks is the uncertainty makes it hard to plan stuff

Denise diz (11:21):

what part of the process are you in?

Denise diz (11:21):

yeah, the uncertainty sucks

The Devil Inside diz (11:21):

the waiting part...heh

The Devil Inside diz (11:21):

we are waiting for her to get interviewed

Denise diz (11:21):

that's really weird

The Devil Inside diz (11:21):

yeah

The Devil Inside diz (11:22):

its been kinda a hellish situation

The Devil Inside diz (11:22):

nothing compared to yours though

The Devil Inside diz (11:22):

that sucks that you have to be seperate

Denise diz (11:22):

there's people I know who have been waiting for over a year

Denise diz (11:22):

they have complicated cases though

The Devil Inside diz (11:22):

jesus

The Devil Inside diz (11:23):

yeah...my wife is a belgian student

The Devil Inside diz (11:23):

not much complication

The Devil Inside diz (11:23):

whats your husband do?

Denise diz (11:23):

and there is a lot of people who cant show their IR statements or cant prove that their're above the poverty line

Denise diz (11:23):

he's a software engineer

Denise diz (11:24):

well, I'm a brazilian engineer!

The Devil Inside diz (11:24):

yeah that was hard for us, because i dont pay taxes

The Devil Inside diz (11:24):

to america, that is

Denise diz (11:24):

I am fluent in english, i have a degree... it doesn't matter to them

The Devil Inside diz (11:25):

yeah, degrees and speaking english matter ALOT

Denise diz (11:25):

it doesnt make the process go any faster

Denise diz (11:25):

chris lived here with me for a while

Denise diz (11:26):

but his company needs him there now

Denise diz (11:26):

this visa process is wearing my nerves out

The Devil Inside diz (11:27):

good thing you are brazilian and not venezuelan

The Devil Inside diz (11:27):

lol

The Devil Inside diz (11:27):

youd never get approved, then

Denise diz (11:27):

don't be offended, but i dont think it is fair that people from belgium get to have a k3 approved in 6 weeks

The Devil Inside diz (11:27):

lol no offense at all!

The Devil Inside diz (11:28):

we were like "what the ######?! really?"

Denise diz (11:29):

it'd going to take 8 months for us

Denise diz (11:29):

because USCIS is backloged

Denise diz (11:29):

are you sure it's a k-3 you are getting?

The Devil Inside diz (11:29):

im looking up the time thing right now

The Devil Inside diz (11:29):

to show you

Denise diz (11:29):

did you file forms I-130 and I-129F?

The Devil Inside diz (11:30):

yep

Denise diz (11:30):

do you mind if I post this conversation?

The Devil Inside diz (11:30):

where?

Denise diz (11:30):

visajourney

The Devil Inside diz (11:30):

feel free

Denise diz (11:31):

thanks :)

apparently, if you live with your spouse in belgium for 6 months, you get some kind of express filing

is this direct consular filing? wasn't that only for people who are married and abroad for 2+ years?

You can direct file if you meet the residency requirement for the country you are living in. The length of time to meet this criteria does vary by country (6 months for the UK).

If this person is direct filing, they are going the CR1/IR1 route because K3 is not possible. I think that's where the confusion arose :)

LOL who is the "they" as in "they told us?

If this person thinks it takes 6 -8 weeks to get a visa they are sadly misinformed.

I have seen these sorts of posts pop up occasionally on various sites. I have yet to see anyone with visa in hand in such a short amount of time. About the quickest K3 adjudication I have seen from submission to approval notice was around 50 days, but then it still took about another 4 months or so to process through the consular. We all know the steps involved in this process and just with postage alone to the various places will take weeks of time, let alone the adjudication of the case at both the US and consular levels.

Let this person believe that their case will be done in 6 weeks, you wont be able to tell them otherwise until the timeframe passes and they start posting the why is it taking so long when we were told....yudda yudda yudda. It does not matter what country the person is from. All cases are accepted on a first come first serve basis. ALL.

ahhh now if they are doing DCF, thats a different kettle of fish.

Yep, that's direct consular filing. It's not really "express filing". It's just that overseas the I-130 approval process is much faster because each consulate is dealing with so much less than the US service centers.

Your IM buddy was confused - it must have been the I-130 (there is no I-150) and it was a CR1 or IR1 visa, definitely not K3 visa.

It is true that after a USC has been living in Belgium for 6 months on a residency visa, they could file the I-130 directly with the consulate. Six to eights is incredibly fast, and I can only imagine it's that they don't handle very many - not the stuff your IM buddy was saying abou the EU. That's kind of weird. In London, the process is more like six months, which is still faster, but not crazy fast.

If you lived in Brazil on a resident-type visa for six months, you could also file directly at the consulate in Brazil and have a much quicker process than you are currently experiencing.

Looks like it would take about 5 months in Brazil to get the immigrant visa, which is pretty good.

If so, is there a way to still try that even though we're already processing k-3? Or is it even woth it, considering our timeline?
