Getting married in the US and then moving back to Europe?

Hiya,

Well, here's my question. What if after getting married, time goes by, all the paperwork is done and I become a permanent resident... and then we decided to move back to Europe? Would be need to file more documents so that my future husband can move legally to Spain? Or would it me more simple?

Just wondering what may happen if after a while we decided to live in Europe.

Permanent resident status is for PERMANENTLY living in the USA, not another foreign country

Maintaining Permanent Residence

You may lose your permanent residence status if you commit an act that makes you removable from the United States under the law in section 237 of the Immigration and Nationality Act. If you commit such an act, you may be brought before the immigration courts to determine your right to remain a Permanent Resident.

You may be found to have abandoned your permanent resident status if you:

• Move to another country intending to live there permanently.

• Remain outside of the US for more than one year without obtaining a reentry permit or returning resident visa. However in determining whether your status has been abandoned any length of absence from the US may be considered, even if it is less than one year.

• Remain outside of the US for more than two years after issuance of a reentry permit without obtaining a returning resident visa. However in determining whether your status has been abandoned any length of absence from the US may be considered, even if it is less than one year.

• Fail to file income tax returns while living outside of the US for any period.

• Declare yourself a “nonimmigrant” on your tax returns.

I would recommend not moving until you have US citizenship. If you move to Spain as a US permanent resident, you will loose your status and should the two of you decide to move back to the US later on, you will have start all over again from the begining with one of the spousal visas.

As the others have stated, the point in becomming a PERMANENT resident of the US, suggests that the time and effort you put in to getting that status, pays off by letting you permanently reside in the country.

I would of advised you to see how you can get permanent residence in the country you want to move to, not America.

You can loose your status if you stay outside the US too long.

If you want to move to Spain, the US doesn't care, you don't need to file anything with USCIS. Just pack up and leave! Just know that, like others have said above, if you're out of the US for too long, they will consider that you've abandoned your status as a permanent resident, and you will have to start a whole new immigration process from zero if you ever want to move back to the US.

There are also forms you can file if you intend on keeping your LPR status but will be out of the US for a known amount of time -- you can let them know in advance that you're leaving but will be back, and you may retain your LPR status... there are restrictions of course and I don't remember the details, but you might wanna look that up.

On immigrating to Spain, immigrating to the EU is usually immensely easier for a EU citizen's spouse (get a visa within weeks or even days rather than months) than it is for a US citizen's spouse to immigrate to the US, but that info will be available elsewhere, for example on the Web site of a Spanish embassy/consulate.

dont you just have to be in the usa for 1 day a year to maintain your LPR??
