Moroccan Family Law:

Chapter Two: Of Divorce for Other Causes

Article 98

The wife may petition for divorce on one of the following grounds:

1- Non respect by the husband of one of the conditions in the marriage contract;

2- Harm;

3- Non maintenance;

4- Absence;

5- Latent defect;

6- Abstinence and abandonment.

Section 1: Of Non Respect of One of the Conditions in the Marriage Contract or Harm

Article 99

Failure to respect any condition in the marriage contract constitutes a harm justifying a divorce request. Any ignominious behaviour by the husband or act against good character that causes the wife material or moral harm such that the continuance of the conjugal relationship is rendered unendurable shall be considered a harm justifying a divorce request.

Article 100

The harm suffered is established by all means of proof, including the testimony of witnesses, who are heard by the court in the consultation room.

If the wife does not prove the harm and maintains her request for divorce, she may resort to the irreconcilable differences procedure.

Article 101

In the event the court grants divorce on the grounds of harm, the court may fix in the same judgement the amount of compensation due for the harm.

Section 2: Of Non Maintenance

Article 102

The wife may petition for divorce on the grounds of non respect by the husband of his current maintenance obligations towards her, in accordance with the following situations and provisions:

1- If the husband has assets from which to award maintenance, the court may fix the means for paying the wife maintenance, and does not grant her petition for divorce.

2- In the event the husband proves his incapacity, the court shall fix, according to the circumstances, a deadline for the husband not to exceed thirty days to provide maintenance to his wife, under penalty of divorce, except in cases of force majeure or exceptional circumstances.

3- The court shall grant the wife's petition for divorce immediately if the husband refuses to provide maintenance and does not prove his financial incapacity.

It is not always grounds for divorce. You simply don't know what you're talking about then you speak about Islam, peezey. Frankly, as an atheist, you have no basis upon which to claim authority regarding this subject.

That you get your Islam from websites is more proof that you know little.

BTW, there is more than one sharia, as evidenced by mutiple schools of jurisprudence and their differing rulings. One may allow divorce on the grounds of a man's ability of lack of ability to support his wife, and another may not. If you now anything about Islam, you know that. There is much diversity on interpretations of sharia and even what constitutes sharia. Most websites are not substantial enough to teach that.

And? Your husband is Moroccan. You say non-maintenance isn't always a grounds for divorce. It's been discussed here a man accepting money from a woman is not just Islamically unacceptable but culturally unacceptable. So no matter what I post, including the actual law in Morocco, you're going to argue it's relevance away to rationalize your position as a sugar mama, and that's fine, but at least be honest about what you are doing. And YOU are wrong. The moudawan is sharia based no matter how much you think you know.

Again, I'm not promoting or sermonizing jack #######, get over the dramatics. If I were promoting anything, it would be something much more enjoyable, but I'm not a pot head like some of these muslimas on here, so I wouldn't promote that, but something more entertaining than this stupid discussion for sure.

regardless of whether or not I sent any money or spent any money on my husband before he got here and we got married, we had some AOS and EAD problems and my husband spent almost a year without work papers. Although it really bothered him on many many levels, neither of us had any choice but to be thankful that I had a job making enough to support us both. I am not trying to stir up more **** because I am aware of the cultural and religious pressures for the husband to support the family, but those pressures dont take into account reality issues like immigration and work authorization and green cards. So did I have grounds for divorce there? I cant help but think no, which means there must be some exceptions and some situations in which its ok for these 'rules' to be bent.

and as Carolyn pointed out earlier, I make more money than my husband. I have several more years of US work experience under my belt, several more years of corporate ladder climbing. Should he feel bad or small or less of a man because of it? On some level he does, especially with a new baby he would love for me to be able to stay home with her indefinitely, but our lives just wont work that way for now.

I think this thread started out with a worry about being used, and the only way to answer that is to reiterate that people get used in this immigration-go-round every single day and if anyone had a crystal ball to see how each case will turn out that would be awesome but it just doesnt exist. I have seen some couples on here that seemed rock solid and turned out to be NOT, and others that if I were a gambler I would have bet would end as soon as the green card was attained and yet they are still together. there is no easy answer to these questions.

I didn't say that non-maintenance is not a grounds for divorce, I said financial support is not an absolute obligation of the husband. I gave the example of the Prophet whose first wife supported him, whose other wives worked to support the household, and who were left with no inheritance from him. I said that sharia, its content and interpretation varies by madhab and by application in the Muslim world, and that Moroccan law is not exclusively Islamic. Accepting money from a woman is not Islamically unacceptable; that is evidenced by the Prophet's Sunnah and by the ayat in the Quran which explicitly allow a man to accept gifts and money from a woman.

None of this is BS.

Hello

If anyone is up at this time at night would really appreciate an honest answer. I met Salah my fiance in Jan. in May after I arrived, payed for the apartment for a month ( as his job is not providing him enough money to live on) he asked me for 200 euro to pay for a bed with a bunch of guys. As of June I have paid. I understand that work is not good for him, and have asked him on occasion to go back to Morroco where he could live for free. He said he would go if I went with him. He does not care he says about the visa.. and on to go further would rather live in Italy than the U.S. I am the one who thinks he should live here, as my buisness and I think life here is better. Anyway in a nutshell, yesterday, he called me to tell me that the Italian police had confiscated his posters. ( he sells these on the street) I lost it. I told him to move back to Morroco..went on and on about supporting him with his apartment for six months. Anyway, I don't know what to think. Is the guy using me? In my gut I dont think he is..

any wisdom would be grea!! And I realize this site is for visas and not for relationship help.
