A change to VJ Guides?

We recently received an RFE because I did not include my fiancee's birth certificate with the petition. It doesn't say this in the guides...most likely because it wasn't something requested before. I have seen this a few times now where this issue has come up. Perhaps there could be something placed in the guides that USCIS may ask for the birth certificate (translated) of the beneficiary. Also that there is a chance for an RFE should this not be included. Something along those lines.

By fiance if you mean the non USC then per the published requirements they do not require this... that said they can ask for whatever they want (so to speak). I may add a footnote like you said to reference this. Have you noticed any trends from specific countries or otherwise?

I don't have specifics but I do remember reading this in two other cases where they received RFE's because they did not include the non USC's birth certificate.

Hey, I just replied to your other post. That's really weird. We never sent my fiance's Thai birth certificate because it is not asked for in the K-1 application to USCIS. Everything was processed fine and approved. I have no idea what's going on. The other day a guy wrote in saying his Thai fiance was denied a visa because the embassy people (supposedly) told him was not allowed use a co-sponsor for the K-1 visa application to make the 125 above poverty guideline. But another guy just wrote a review of the Thai Embassy saying they ASKED his fiance to provide a co-sponsor before she would be approved for a visa.

Yeah, have no idea what's going on. Seems this is more a subjective than an objective process, and they'e just doing things at whim or suspicion.

I sent in a copy and certified translation of Nid's birth certificate because her birth name was different than her current name (which is common in Thailand), so her marriage/divorce/name-change certificates (which are asked for) would have not made sense to the adjudicator.

They dont so say the USC's birth cert is "required" but they can ask for it if they feel the need.
