Hi guys,

My Fiance and I are getting married next month hence he will be sponsoring me using form 1-864 when we do AOS.

Here's my question- he hasn't filed his last tax return for 2005 yet and has got an extension to do this, so do you think it will be OK to just supply 2004 figure on the 1-864 form and give and prior tax returns?

Also, this tax return for 2005 is looking like it will be below the poverty guidelines (2004 was not) but now he has a job that is way above the guidelines and has been in it for about 8 months....

Does anybody think I will need a co-sponsor? Based on his current employment, and I believe they put most emphasis on this, we are way above the guidelines.

If anyone would mind sharing their opinions/experiences I would really appreciate it.

Yeah, I think you should just submit the 2004 taxes and a copy of the notice that you have an extension on the 2005 ones. If your extension deadline has passed before you file AOS, I think you should get a co-sponsor. Co-sponsor is no big deal, I used my mom, it's just a matter of filling out another form.

Then when the interview comes around, be sure to take whatever taxes you have for the last 3 years at that time and a letter from your husband's employer stating how many hours per week he works and what salary, etc. I think you should be fine.

5/23/03: Justin arrives to visit me in IA from SK.
6/7/03: We got married!
8/23/03: Filed I-130 from SK
8/25/03: Phoned border guards & asked if J could escort me back to IA, yes.
8/26/03: Arrive in IA
8/27/03: Went to USCIS local office to ask if J could stay in the US and file papers, yes
2004: I-130 approved!
6/05: Filed AOS/EAD
7/2/05: Rec'd receipt for I-485
8/05: Rec'd RFE for Biometrics
9/9/05: Rec'd RFE for medical
12/2/06: EAD APPROVED!
12/5/06: EAD card rec'd
1/15/06: AOS interview date for 4/11/06 at 11:00 a.m.
4/11/06: APPROVED!!!!!! NO MORE USCIS FOR 10 YEARS!!! WOOHOO!!! 2016...seems more like a page # than a year. Haha.

Thanks for that, I agree that's a good idea, I've asked him to get a copy of his extension letter and that should suffice I hope. He totally makes enough now and we can prove that, so I can't imagine they would want to reject us based on one years low earnings- I figure it would be a good excuse 'I am getting married so I got a new, better paid job!' makes sense to me, fingers crossed immigration think the same.
