I had talked to an Officer at the USCIS office service center, she told me that our I-130 now is at the california service center due to an address error on my P.O. Box number it has now been corrected so what she had told me is that Now we can wait for a Final decision on the I-130 and not continue with the I-129F this was her suggestion she had told me that the only reason people continue with the I-129F is for there spouses to be able to come to the US and wait for the Visa Approval I am so confused can someone please tell me the correct steps and is this woman right or wrong this has been a difficult journey for my husband and I, I am trying so hard on all this please can someone guide us and tell us what is the right way everyone has or is receiving there first NOA 1 and we are still waiting i sent the application on the 10th of March and it was received on the 13th of March the NOA letter was sent to the wrong post office box and returned i was given the receipt number of the letter by an officer and now I have no idea really how long we will have to wait it's the first step still it isn't fair for us to have to wait another 30 days but this is what i was told please please help!! :(

Patients my dear! you will need it. its not a fast process at all.

K-3 is designed for you to have your spouse come to the USA and wait out the I-130 green card process. however, your spouse is comming from Morocco and moroco embassy is having alot of problems now. the odds of your husband coming on K-3 to wait out the process is closer to not happening.

if your husband luck out and see the k-3 visa once he is here he will have to AOS < adjustment of status >. this is basicly starting all over in the process. that means paying all the ugly fees all over and having an interview again. and waiting the dreaded AR/AP process in the USA. less you send him back to morrocco to interview for Cr1.

you ultimately need CR1.

that the AP/AR process is long security checks that can last 19 days to

2 years. no matter what option you choose your husband is commng from a muslim nation for some reason. the security checks can be delayed for a very long time. more than likely your husband will see the dreaded 221g AR/AP. its very rare that a male will avoid this fate.

if your husband was comming from UK or CAN. the K-3 would be ideal but also usless because normally from those countries the Cr1 is much faster than the K-3. but, not in your case.

so on one hand the USICS is correct in saying K-3 is to allow your husband to come over wait out the I-130 process. but on the other hand its wrong because, its rare they allow any of us to have this

" luxuary" :(

they are also right in telling you to persue the I-130 and avoid the k-3.

example. in my case altough a diffrent embassy we have been on AR/AP 9 months now. making the k-3 usless. my husband should have been here waiting.

so I would do this :

continue with BOTH. if there is a problem with the I-130. some problems with I-130 could be unforseen "RED FLAGS" anything could happen, you never know.

the I-129f will make it to the embassy with a quickness. the K-3 < I-129f > historicly is designed to get to the embassy in weeks versus months.

the reason why I say persue both is because, your husband hopefully can get an interview date Faster. if he luck out and get the k-3 he will be with you all the sooner. why blow your chances for a little something special. who knows you could be that one in a million that get your hubby home fast!

now if your Cr1< i-130 > reaches the embassy before the K-3 this will automaticly cancell. the odds are your K-3 reaching the embassy very soon. right now persue both!

the wait for the I-130 once approved still takes months to reach the embassy. roughly 3 months. this is because you have alot more paper work and fees to compleate.

Your husband is coming from a T country and I do not find many of these men coming without some type of Administrative Processing or Administrative Review. If he was coming from Pakistan he would not be allowed here in K3 it would have to be on a CR1.

You were told right and I would persue both paths. Shon told you correctly to follow both paths if you can. Ultimately it is not easy path coming from Morocco or Pakistan.

Shon filed the K3 and approved and her husband is not here. She did the CR1 as well and that is what the embassy will issue once they finalize her processing.

I filed the K3 and it got to embassy first; then one week later my CR1 arrived. The K3 was cancelled and we are in AP now since our interview this past December.

Pray for patience and read up on Administrative Reviews is my suggestion.

For someone like myself starting out in the process that is fantastic advice the you have both given. Reading this makes me feel I made the right decision to file for the k-3 as well.

Why would you ask if whatever the Officer told you was right or wrong? None of us here on VJ are USCIS Officers, nor do anyone of us here work for them either, including as janitors, so you're asking the wrong people.

It's so ridiculous that people going through this whole immigration process question every little thing the 'CIS does, says, writes, mails, etc. They DO and MUST have their own specific reasons for their actions, which none depending on them should neither question, argue, nor complain about.

Why would you ask if whatever the Officer told you was right or wrong? None of us here on VJ are USCIS Officers, nor do anyone of us here work for them either, including as janitors, so you're asking the wrong people.

Just want to be happy and with my Husband there is nothing wrong with that is there!!!
