I am wondering. We got our I130 approved on Oct 10th at USCIS and still have not received our case number at the NVC.

My father in law has been cancelling cancer for the last 2 years and my husband just found out that he was given another 3-6 months tops to live. I just gave birth 2 weeks ago to our second child which is now a us citizen as well when i got his US citizen birth certificate abroad at the american consulat. Is there any way that you can have a case expedited at NVC?? We have all the proof and my husband and father in law are ready to see there son or grandson...especially now that he has not much longer to live. My husband also lost his grandfather the same day our son was born.

Can anybody give me some help so I can get this case moving. My husband and our 31/2 year old are in the US and my newborn son and I are here.....any advice???

The only time I have seen anyone report a case being expedited was for military deployment. I guess all you can do is try so hope you have positive results.

Sounds like the father would qualify for a B2 visitor's visa, as an imminent death is probably equivilant to the consular officers to be a compelling tie which will force him to leave the country.

I would call the NVC to find out what you can do. But don't get your hopes up, the chances of them expediting anything are slim to none.

Who is the USC? You or your husband?

If it is your husband who is the US, I wonder if he can apply for advance parole in this situation for you where you can show that there is 'extreme hardship' on the USC. "Extreme hardship" is difficult to prove from what I've seen, and I'm not sure how long that process would take.

I highly doubt the NVC will expedite a case, but you can ask.

If you are from a VWP country, it is easier to visit the US. Entry is not automatic, especially since you've shown intent to immigrate by going through the visa process, and it's up to the border guard. You'll have an easier time at the border if you bring evidence of ties back home, are honest and have a return ticket home.

Showing extreme hardship is not required for humanitarian parole to be issued.

The standard is "Urgent humanitarian need or significant public benefit."

Generally, denial of a visa is a prerequisite to applying for parole.
