Hi,

I got request for initial evidence (I-485). It is:

In order to process your application further, the petitioner/sponsor on form I-864, Affidavit of Support must submit all supporting tax documentaion (W-2s, 1099s,etc) submitted to the Internal Revenue Services (IRS) for the most recent tax year.

My husband is self-employed and we still didn't get his tax return, we are waitin for one to come these days since accounter extend time for it so we sent all copy of individual tax return that was subbmited to the IRS.

Anyone with same problem, what do I do now? Anyone with same problem?

The extension of time to file expired 08/15 and can be renewed for another 2 months with reason until 10/15. Is his tax return still unfiled for 2006? You can always order a transcript from the IRS for any return that has been previously filed.

However, if his return was filed then a copy of his return (including all schedules, attachments and earnings statements (W-2, 1099) should be or have been OK. What did you send?

My husband is self employed and he doesn't have w-2. We filed copy of individual tax return that counter submitted to the IRA. It was two bunch of papers, I think schedule were include it with it because we filed everything what accouter needed to submitted to IRA.

I am not sure what to send, just wait for tax return and then send?

I guess I am a bit confused... If your return was filed by 10/15 (the second deadline) then your husband/you should have signed the return before it was filed and provided copies of the return at that time. If you think you will receive a different copy from the IRS then you are mistaken. As a self employed person, your hubby probably received some 1099's... did yo usend them copies?

Historically W-2's (what employees receive) were submitted as a part of the Form 1040 and 1099's (what a self -employed typically receives) were not. So, in your case submitting only the Form 1040 without providing in addition any form 1099's (which are probably a part of your husbands business records) most likely did not meet the documentation need for I-864 and thus a possible reason for the RFE. Look in your records for any 1099's and then resubmit everything the RFE asks for including the 1099's.

Hi. If your husband was self employed, then he received income from some means, typicaly either from providing his services to another person/company or by selling products. If he provided his services (such as being a consultant or such) than the person or company that he provided those services to would have been (more than likely) required to provide him with a 1099 statement at the end of the tax year documenting the total of payments for those services. If he sold products, then his accountant would have records of total sales, total expenses, etc, including net profits - which he would have (probably) used to pay himself a salary. In either regard, there should be some documents identifying the net income he received during the tax year. These are the documents that you also need to provide to the USCIS, in addition to the copy of the tax return.

Ask the accountant what documents were used to document your husband's net income.

Have your husband call the IRS 800 number and request his last 3 years most current TAX TRANSCRIPTS, send those tax transcripts into USCIS, they are official record from IRS and USCIS seems to like these quite well as proof of income or for those that do not have 1099s or W2s as your husband did not have. Hi, thanks for answer. We didn't send tax transcripts for 3 years because my husband didn't make enough for 2004, and 2005. We only sent for 2006 because he made enough money. We are going to figure out this hopefully, because my husband have buisness which is in corporation, and that kind of corporation don't use w-2 or 1099, they using something else which is called K1, and we did sent that. We are going to have accounter to write letter, and we are going to send everything again.

Hopefully everything is going to be ok.
