does anyone know the link to the page on the uscis website that says they will process cases in the order received?

I am going to fax the copy of my receipt (with the received date highlighted) and a copy of that document..

we talked about it before but now i cant find it

does anyone remember this conversation??

Hey, let us know how it turns out. Our timelines are pretty close to each other. VSC received ours on 11/21/07, sent out NOA1 dated 01/25/08, and I see people who filed after us who have received their NOA2 which I do not think is fair.

no, it isnt fair. We all that are getting left behind have very very heavy burdens to carry. :(. hopefully it will all pay off soon.

So pretty much no one can say that things are unfair because they never mention anywere else that they use the FIFO system.

USCIS doesn't say "FIFO" but FIFO is the equivalent of processing by receipt date which indeed is stated by USCIS.

In that respect, they both agree. FIFO tends to be used in computer circles and not in regular life. So that it doesn't show up on the USCIS site should not be of concern at all. It is geek speak.

Maybe they do say that but we are still unable to provide a link for Shrew that shows that their procedure is to do things based on the date. At one time when there were issues with the delay problem they had on their website stating that they would honor the date recieved and that things would be done on a first in first out baisis, now there is nothing that shows that on the USCIS website :crying:

Yeah I was suprise to get my case# so quick...I'm upset though cause I lost two weeks since they rejected my email and I had all the necessary info but NVC was just to lazy to read my email...so this week didn't produce anything for me...hopefully next week I hear something different...you email the DS3032 as soon as you hear the message "The DS3032 Choice of Agent and Address was sent to the Beneficiary on so and so date blah blah blah...once you hear that send the email...

06.18.2008: Case Complete (So upset that it took this long 37days)

What do you mean? It says they process by receipt date clearly on their page. That it also says it could take as many as 10 months to process is possibly true but irrelevant. Only *if* the previous apps have RFEs does going to someone receipted afterward make ANY sense at all.

Even if they were to honor the actual NOA1 date, we're still screwed because my NOA date is January but people who were received after that have gotten approved.

Bottom line : FIFO is FIFO. Receipt date is receipt date. The date of the NOA is not the receipt date -- the receipt date is clearly stated on the NOA1.

"USCIS processes applications in the order they are received by application type"

How much clearer can they be that this is supposed to be FIFO?

They need to answer about the drunken sailor route they are taking through the applications.

remember how I told you that they acted like I might have a RFE and then we decided that was just an automated message?

Well, I get a letter today saying that I dont have an RFE and I was never sent one b/c there isnt one showing up and that my case is still within processing times and they are processing cases up to july 30 and that all I have in my case is my receipt and since I might have "misplaced" it they issued me another one.

so. now I have two NOA1.

it still has my october filing date but now the new receipt is for April 18.

same receipt number.

weird.

so..they have time to do all that but no time to approve me? :(

so sad.

anyone else have something weird like this happen?
