If you have read my previous Update post that I posted Yesterday, you will think that I have little more to worry about, well, my wife gets home this evening (I'm working away from home during the week right now) and she has a letter from the embassy saying that she has to supply proof, in the form of an affidavit. She also has to find three other people to give affidavits who know us, they also have to provide proof

AHHHHHHHH

That was me when my wife rang me to tell me. So tomorrow she has to run around find a lawyer, my sister, mum and best man also have to run around finding lawyers (I assume I can use my family).

Can somebody let me know if I can use my mum and sister with this embassy request.

12/8/07 - Applied for Police Certs

14/8/07 - Police confirmed receipt

20/8/07 - Posted I-130 to London

25/8/07 - I-130 Returned asking for copy of Andrea's student visa and more proof that we live in the UK !!!

25/8/07 - Posted I-130 Back to Embassy In London (1st class recorded delivery) with copy of Student Visa and copy of Council Tax Bill

29/8/07 - Received E-mail (assume it is NOA1) confirming filing date of 29th Aug 2007 - YAY :)

30/8/07 - Money debited from our Credit Card

01/09/07 - The waiting begins :)

14/9/07 - Police Records Returned

1/11/07 - A company that interviewed me has offered the services of an immigration lawyer

7/11/07 - Immigration lawyer files my DS-230 and Notice of Readiness

8/11/07 - Embassy requests further information proving a viable marriage (if anybody hasn't yet filed their I-130, I would advise that you send the following with the I-130.

1) A affidavit from the petitioner detailing their relationship, how it started, developed, etc, etc

2) An affidavit from three people who know you both

3) Past emails, flight bookings, Pics, Dinner receipts, phone bills, etc, etc

12/11/07 - Send all the above back to Lawyer in London

26/11/07 - Lawyer got a case number and I have booked my Medical, I-130 STILL Not Approved

26/11/07 - Got the official offer letter from the US based company - YAY

27/11/07 - It official, the idiots at the USCIS have lost the RFE parcel - grrrrrrr

28/11/07 - RFE resubmitted

3/12/07 - I-130 APPROVED (NOA2)

4/12/07 - Medical

13/12/07 - Interview - APPROVED :)

29/12/07 - Arrived in Philli

Yes, definitely, family is fine, maybe even better, as long as they know both partners. :)

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly

I just so didn't expect this, espesially as they had already returned the I-130 becuase of this reason and I sent a cousil tax bill showing we lived together. I so think they should ask for this to send along with the I-130 in the first place.

Just talking to my wife and the difficult bit we are having is finding any Clean emails we sent to each other in the early days we can use to support her cliam :blush:

Yep, everyone who filed after July and followed London's instructions to the letter is getting them.

It's not just those who filed after July -- we filed in January and got an RFE for such affidavits! :angry:

Well things moved on a pace today, the lawyer the company I'm potentially working for hired came up with all the required documentation and emailed it over to me tonight, just have to get the family to sign them all this weekend and then post on Monday :)

If this is happening more and more maybe the Mod of this board should pin some general advice to get this information before submitted the I-130?

I'll be very interested to see what happens with your DS-2001 and DS-230 that were filed before your I-130 was approved.

I thought about submitting them with the I-130 but was advised against it on this board, and decided to go with the advice. It'll be interesting to see if it's processed sooner that if you had waited for your I-130 to be approved. Keep us updated! :thumbs:

You won't get asked for the affidavits, as that's part of the I-130 process. Things change quickly! It was just a month or two ago when a ton of people filing I-130s in London started to routinely get asked for these affadivits. Before, it was better to not spend the time and money on it if you didn't have to, but now it sounds like it's better safe than sorry. Not that there's anything about on the embassy site - oh no, that would be much too helpful! :P

yah u may use a lot ofg proofs not only notary from ur family and that conatians:

1.phone bills, if u call from home.

2.mail letters.

3.emails

4.txt's

5.pics togather and pics of ur spouse with ur family.

but how can u save emails, all u can just get in ur inbox and save as the whole page that conatins ur emails to ur spouse, and save all pages if u can on cd or floppy disk.

I'll keep everybody upto date, my affidavits got posted back to the lawyer today along with all my other evidence. Hopefully things will be turned around fairly quick.

They have already done the other support. This is only in regards to receiving an RFE for the affidavits.

How much does it cost to get these things notarised???

Can anyone reccomend a reasonably priced notary in London?

My London based lawyer came up with the affidavits and my local solicitor took them and signed them with our supporters. As the solicitor never drew up the paperwork, he only charged £5 for each persons affidavit he signed. I have no idea how much the lawyer charged to draw up the affidavits.

wow, I thought it would be much more. So if I used a template affidavit and drew them up myself, the notarising shouldn't break the bank. Great to know, thanks :luv:
