Hello everyone! (i'm a U.S. Citizen)

Well Im going straight to the point, We live here in MIAMI fl, and my mother had her enterview the other day,

so we went and the lady that talk to us, told us that her I-130 has been Approved But Due to that in 1984 my mother enter the Unite states ilegaly to California and her Visa was taken away, but during that time she left the country and went back to hers. ..... in 1997 my mother apply for the turist visa and got approved, she has come and gone to the united states many times but 3 years ago she decide to stay because she wanted to live with me so since im a Us citizen I send a petition for her to become a US resident.

Ok so the Lady that gave her the Interview told Us that due to what happen to her in 1984 in California they cannot continue to process her paperwork, Until we Close That case that happend in California, she gave us a paper explaning what happen in 1984, and also she gave us a paper which shows that

her I-130 has been approved so that way in California they know that her old case can be close, she told us to go the immigration Justice court in miami and that we need to show those two paper so they could closed that case once in for all, because it happen almost 23 years ago. We went that same day to the Immigration justice Court of miami and we show those two papers but they told us that it was out of their Juristriction and that we need to get in touch with the Immigration Justice Court of California so they could process that old case.

My mother yesturday went to a lawyer and show her the papers and explain to her what was happening, so the lawyer told Us that she could help

us But we need to pay her 2000 dollars!!!!!!!!!!!!!!!!!!!!!!!!! thats crazy!!!

My question is has anyone had a Case similar to my mothers?????, I told my mother that that lawyer was crazy and that I think that here in Visajourney there's alot of people with similar cases like hers and that they could help us.

I know this because thanks to this pages I was Able to bring my fiancee now WIfe to this COuntry with NO NEED OF A LAWYER that all he/she wants is to get paid!!!

Can some please Help Us or tell Us how can we get in touch with the Immigration Justice COurt of California!!!

thanks.

PS: my English is not the best sorry!

Sounds like you are dealing with a case where a person, your mother has overstayed two visas, (3 years ago and back in 84) this is a case where you will need a lawyer. Your mother may face a 10 year or perhaps even a lifetime bar if she leaves the country now.

OUR TIME LINE Please do a timeline it helps us all, thanks.

Is now a US Citizen immigration completed Jan 12, 2012.

Sounds like she has an outstanding Deportation order, but whatever, I agree you need a Lawyer.

Immigration Law is Federal so a local lawyer is fine.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”
