Hello everyone please give me some advice on my case. On the interview day they ask my gf only few question and gave her a blue slip requesting more evidences. I sent her all the thing they requested when she went back to give it to them they ask her to wait then give her another slip saying that they think my relationship with her is not real. and they will send my case back to the US. I did send them all the thing they requested and they happy with it but still refuse to approve my case. anyone have any idea what make them think that my case is not real. so what should I do now. please show me some light.I feel all black now. thanks.

Generally an attorney is required to overcome a Notice of Intent to Deny. If you want more advice than that, we would need the details behind your overview, such as...

What questions? What evidence was asked for? What did you provide? Why do you think they made this decision?

I know alot of cases have been returned to the US from Morocco, so you might want to ask in the MENA (regional Middle East/ North Africa) forum.... doesn't matter what country, I'm pretty sure the processes are the same and those in MENA who have been through it know what to do.

I do know that time is of the essence and you need to act quickly. Ideally before they actually do send the application back.

Seeing that your fiancee is in Vietnam and I've been following VJ forum for quite some time and have heard a great success from this one lawyer. His name is Marc Ellis and he is currently in Vietnam and have expertise in this area where has has helped many get their visa from a blue/green slips. I would contact him ASAP before they sent your case back to the US, if it hasn't already done so.

I agree with MR2nice, you need to contact a immigration lawyer in Vietnam, to try and keep it there. Once it is returned to the USA, you are in for a very long and costly appeal process. Good luck

The same thing has happened to many of us at HCMC consulate. The best way to overcome a blue slip is for the petitioner to be there at the consulate to deliver any documents needed to convince them the relationship is real. I haven't heard of any one keeping the case there after a green slip. The case is sent back to NVC and then to USCIS where it will most likely expire and you can file a new petition. That is what happened to me.

CSC told me it is returned from the consulate as expired and they would not re-open it or send me any notification. There are some recently denied visas from HCMC that have had an NOA sent to them from CSC that stated they received the returned petition and it would be adjudicated in the order it was received but I haven't seen any action taken on them yet.

The best way to gather information on your case status is to contact your Senator or Representative.

P.S.

I am learning as I go. My old case was touched at the same time my new case left NVC to the consulate. I don't know what the relationship is between them. I called both NVC and USCIS and ofcourse I got no answers. I contacted my Senator for help.

Had to make an Info Pass appointment because there was a delay in receiving the NOA for our I-751. Never found out the reason for the delay but they gave Thao a 1 year green card stamp in her passport and we got a the NOA 2 days later.

thanks alot everyone for your time. after the interview they gave her a blue slip requesting more evidence about the relationship, and ask me to give a time line from start to now. also prove of airline ticket purchased and transcript of 2006 tax. I gave them copy of the airline ticket and 3 yrs of tax return already but don't know why they still requesting it. I gave them everything and they happy with it. they don't request anything now only said they don't think my relationship is real. and will send my case back to the US. anyone know any other good lawyer. I try to call Marc Ellis 90-835-8009 but couldn't reach him. thanks alot everyone.

hello everyone.

On the letter they said: you has failed to submit sufficient credible evidence to support the claimed petitionable relationship. and also said beneficiary could not provide evidence to support the claim that petitioner funded his own trip to VN. I already gave them a copy of the airline ticket. I purchased it with money order but i lost the receipt so i wrote them a letter explain that along with the prove of purchased from the travel agency. why they care so much about me able to pay for the air ticket or not when I got more than 10k cash on the bank which i had show them.and make over 20k a yr. the air ticket is only over 1000.

anyone have any advice what should I do now. I'm still contacting the lawyer. hope can find a good one soon. thanks.

Sounds like they think someone else was financing you to petition the lady.

Happens for real a LOT.

Also sounds like you didn't have much proof of a bonafide relationship.
