Hi,

I am a US citizen and I am filing for my wife i-130 and i-485.

Background info on my wife:

She came to the US in 94 on a visit visa with her family and than they applied for asylum. There case was later rejected but they were never issued deportation orders. Since than she has been filing for Work Authorization and receiving them with out any problems.

My Questions:

1. Should I be filing both i-130 and i-485 together or should I first file for i-130 and wait for approval and than file i-485.

2. On part 2 of i-485 form it asks “I am applying for an adjustment to permanent resident status because” should I pick the last option “Other basis of eligibility. Explain (for example, I was admitted as a refugee, my status has notbeen terminated, and I have been physically present in the U.S. for one year after admission). Ifadditional space is needed, use a separate piece of paper.” And say that form i-130 is being concurrently filed for me.

3. On the i-485 form it asks for Current USCIS Status, should I leave it blank or enter “Over Stay of visitor visa” or just say None.

Your answers will be greatly appreciated.

1) Yes file I-130 and I-485 together.

2) Applying based on an Approved I-130 "A"

3) Form says: "In what status did you last enter? (Visitor, student, exchange, alien, crewman, temporary worker, without inspection, etc.)"

If came here as a visitor then put Visitor.
