Here's my situation: My Filipina fiancee arrived in the USA on September 18; therefore her visa expires on December 17. I feel like I need some answers to a few basic questions about the AOS process:

1. Are we required to be married BEFORE we apply for AOS for her?

2. We have only about one month left on her visa; do others wait until this late date to go to the next steps or are we just really late?

3. What happens on our December 17th (end of visa) date if we have not applied for AOS before that?

4. Exactly what documents should we complete?

I'm sure I have a million other questions, so if there is anything else anyone can think of to help us along, please let me know. Maybe many of you that have completed the K1 process successfully feel like I do ... I feel like we just completed so many documents for her K1 that I can't believe it's time to do it all again. Thanks for any help you can give us!

1) Yes. The K1 Visa was about getting married. Adjustment of Status comes afterwards.

2) It's up tp the individual. Some file right away. Others wait a bit. Think we waited 2 months before applying for AOS.

3) The Beneficiary will be legally "out of status". But once AOS is filed, all is good again.

4) Please Read the Guides for AOS before doing anything. The forms are not difficult and the guide has great examples. We used them and simply substituted our info. We were approved in 57 days -

June 4, 2007 - Mailed AOS

June 6, 2007 - USCIS received

June 11, 2007 - NOA1 for I-485

July 18, 2007 - Biometrics completed

July 20, 2007 - Case transferred from MSC to CSC

July 31, 2007 - AOS Approved - 57 days - Without an Interview!

Aug 06, 2007 - Received Green Card in the mail today!

Jan 8, 2009 @ 8:18PM - Our son was born tonight !!

I-751 - Remove Conditions

July 11, 2009 - Certified Mail to VSC I-751 Package

July 14, 2009 - Check cleared bank

July 20, 2009 - NOA1 & 1 yr extension - Receipt date is July 14. Case# assigned

Sept 1, 2009 - Biometrics completed

Nov 25, 2009 - I-751 is approved. No Interview.

Dec 14, 2009 - 10yr Green Card arrived !

First of all get married before the Visa expires!!! Then apply for AOS. Read the guides for AOS. When in doubt...Ask questions!!! :)

Oct 1/09 - I-751 package sent

Oct 3 - package delivered

Oct 5 - NOA mailed

Oct 13 - 1st NOA received and additional letters for my daughters I filed with. NOAs stated Resident Status

has been extended for 1 year and that we will be receiving a letter for an ASC appointment for

fingerprints, photo, and signature.

Dec 2009 - Received 10 year permanent resident card.

Feb 2010 - My children received their 10 year permanent resident cards.

Oct 2010 - My children were legally adopted by my USA Citizen husband.

Hello! The others gave good advice. :thumbs: K-1 visa means you HAVE to get married within 90 days of arriving in USA. You can just register with a short, sweet and simple ceremony at a local county clerk's office, and later do a bigger wedding with family, if you want. Many couples get married just before the 90 days expires, so don't worry about that, just do it as soon as you can! :yes:

As soon as you get married, it is good to file for AOS immediately, although some people even have waited a year or more before filing; your wife will be "out of status" but still legal. The sooner AOS is filed, the sooner your wife will be able to get a job, get a driver's license/ID card, get a bank account, etc.

We all know it is a hassle to again be immersed in paperwork :wacko: but just think, after AOS is filed and approved, your wife can have all the privileges of being a (conditional) permanent resident of USA, and you can happily relax with no more paperwork! YEA! :D
