So here is my question.my visa k1 expires end of november. We have married officially in the court for the paperwork to make it in time, but now saving money for wedding ceremony and honeymoon.my question is can i still travell inside US like Hawai with expired visa and applied for AOS?I mean in before getting green card?

There is NO restriction on domestic travel, only on International travel for K-1 visa holders.

Is now a US Citizen immigration completed Jan 12, 2012.

Otherwise every time we go to the airport (4 times since his K1 expired), we'd be in trouble :) Can I go to Hawaii with you??? :)

Mailed AOS, EAD and AP Sept 11 '07

Recieved NOA1's for all Sept 23 or 24 '07

Bio appt. Oct. 24 '07

EAD/AP approved Nov 26 '07

Got the AP Dec. 3 '07

AOS interview Feb 7th (5 days after the 1 year anniversary of our K1 NOA1!

Stuck in FBI name checks...

Got the GC July '08

On our way back to Houston, we had some issues going through the Sarita TX checkpoint, my wife was detained for about an hour, because her I-94 was 2 days short of expiring.

We had already submitted our AOS paperwork but we didn't have the receipt with us.

The I-94 is expired now and we are afraid for her to travel anywhere close to the border if we have to go through an INS checkpoint? :crying:

What documentation would you guys recommend that we bring next time we head south (not across to Mexico, just to the border area, we know she can't leave the US)? Marriage certificate? AOS receipt? Copy of the submitted paperwork? all of the above? :help:

Thanks for any input you might have :)

BTW I did do a search before posting, but I'm still not sure what to bring with us, I don't want my wife to go through a "interview" process again with the INS clowns at the checkpoint....

If you're worried about having the same scenario again, why not take all of the above. Like others have said, there isn't any restrictions on domestic travel and it sounds like you guys experienced an overzealous border agent. :)

Your K-1 visa expired when you used it at the POE. It's the I-94 that takes over, then the AOS I-797 receipt.

I would definitely carry the marriage certificate and the I-797 AOS receipt. But like KarenCee says, it doesn't hurt to carry a copy of the submitted paperwork, either.

:thumbs: hey guys! thanks for the help! On our way back the INS officer that was inspecting us saw my fiancee's passport I explained that we had alreayd sent the AOS and he asked about the I-94. I told him that as a K1 entry we had to send it in with all the paperwork and he let us through. I guess when you have all the correct answers they don't bother you much :)

My better half got her green card today :dance: thanks for the help!
