Is it ok to get married while filing the I-129F???

I am assuming you are an LPR, Evolution.

Can you file the I-129F now and then have it upgraded once you gain your citizenship? That way you would already be in the process and it may decrease your waiting time.

Alternatively, get married now in Cambodia, do the big ceremony thing, and file the I-130 as an LPR. I believe that could also be upgraded once you get citizenship.

I don't know which is quicker through Cambodia, K1 or K3 - or if DCF is an option for you - so I can't be much more help than that, but it's worth checking if you can file either petition now and then move them up the priority list once you become a USC.

:star:

I was thinking about filing I-129F before while I'm only a LPR. But I heard the process wouldn't go anywhere until I upgraded my status to a USC. That's why I was looking for another option. I could file a K3 as a LPR, but we're not married yet. If I were to get married it would have to be sometime next year. Just don't have enought vacation hours to hit another trip back home for another month. Trust me it's better to take a whole month off rather than just take 2 weeks off for a vacation like this, just not worth it.

Dont even bother. It is clearly unapprovable and they will reject you very early in the process.....just wasted your money. READ the instructions that go with a I-129F and stop posting stupid ideas. You may end up living in Cambodia they way you are going.

\

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

Well, it does seem to me that you don't have a very good understanding of the visas at all!

If you are getting married in the US ONLY, you can file for the K-1, bring your fiancee HERE, and get married HERE. This allows you to get married immediately upon her arrival. After that, you could in theory be granted advanced parole to go back and have your ceremony in Cambodia. I wouldn't, if I were you, plan on any kind of timeline before you had the visa or your advanced parole IN HAND. That's what the rest of uf have had to do, that is how it works.

If you are getting married in Cambodia, you can go and do that and THEN file for the K-3 for your spouse. Yes, it necessitates her remaining in Cambodia while you file. Yes, it means that if you cannot stay with her there you will be separated. Yes, it sucks. But that is the way it is.

Your options are limited because you are marrying a non USC. USCIS is not Burger King, you cannot have it your way. This is unfortunate and a big headache to everyone who has been through this-none of us will call the process easy. It entails separation from our partners and long waits, hassles with paperwork, and sometimes ends in heartbreak. It sucks, but this isn't an easy process for anyone, and people around here tend to get touchy when it looks like people want to find ways around the process-yes, it hits a nerve with people who have been through all of this heartache before you.

LMFAO on the burger king thing. never liked them though. not a burger fan.

Evolution... everyone here, especially Gwen666 has given you the answers here to your question. It just seems like because they don't fit into your plans that they are not good enough. Which way you can pick is stated exactly in what Gwen666 has said a few times already. In your case, you maybe can't have your cake and eat it too. First of all, get your citizenship before you even start to worry about anything else because you can NOT apply for i-129f if you are not a USC. Now here is my suggestion when you got citizenship. A lot of people on this site want to do what you are thinking: have a ceremony in her country so that her family can be there and take part too. The only difference is people on this site don't have an actual LEGAL ceremony. This way they are NOT married and can still go the K1 Visa route but still involve her family. Like a pretend ceremony. This is not visa Fraud and therefore you don't have to lie about anything. Actually heard someone on here went through what would have been the whole legal ceremony but never had or filed the marriage licence, but everything else was the same. they are not legally married so they can still file for K1. they had ceremony and reception with all that. If you intend to legally marry in her country don't even bother filing for i-129f, as your are not allowed to anymore, and go with k3. :)

EVO, why bother?

"With all do respect I'm not trying to lie about it, just that I don't wanna have to start the whole process all over again when the case of I-129 might be at the stage of completion. That could take longer. "

You ARE saying you want to lie about it. I empathize with the fact that you two have already been waiting. However, you could've married on your last visit there, and started your I-130 then if you were worried about speed.

The I-129f is going to be the fastest way here, starting with what you have at this moment.

That you'd suggest to scam the system at this point doesn't say a lot for you EVO, and you're my natz buddy! C'mon, maybe set back the wedding date a couple of months and everything will be OK?

"Time served" with the I-129f pending doesn't mean *anything* if you marry in the middle of it. And, you know how hard it is for Cambodia people to get a visa to the US. Do you know why? Because of too many people trying to play tricks like you suggest here.

Do it on the up and up; I'm sure you will find a way.

Well said Meauxna!

Evolution, have you not understood what a couple of people have said about having a Buddhist ceremony in Cambodia? It is possible for you to have a ceremony that will satisfy her family and religious beliefs, WITHOUT legally getting married! Many of us who have Thai fiancée’s have done exactly that. I had a big ceremony with my fiancée, her family, and nine Buddhist monks. It was a great ceremony, with all the pomp and circumstance, but we did not register with the Amphur, so we are NOT legally married. We will do that when she gets here next month. That is your only option, other than wait, or get married and go the K-3 route.

Good luck.

I am sure almost every single person here did not get to marry according to their plans or what their dream was. We all have to follow the visa process and change our plans accordingly. We have all had to wait an obscene amount of time before we could be with our loved ones. There are those here who have had to wait for almost 2 years from the start of the visa process, and there are those who are still waiting.

If you want to get married in Cambodia, then a K-1 is not for you. A K-1 is the visa option for those who intend to marry in the United States.

Don't make any wedding plans until after you figure out your visa options, and then make your wedding plans according to the visa options, not the other way around. That's the reality if we want to marry a non-USC.

I suggest you get your USC and file the I-129F and hope its done in time for your wife to return with you.

Have a ceremony in Cambodia and then travel back to the US and have a legal wedding done. Problem solved.

In a way it's kinda like lying to them about the ceremony, Isn't it? That's what I was thinking about when wanting to lie about it, but have it done legally. In this case well just not have to do it legally. And just proceed as planned with the wedding ceremony.

I sort of see what you mean. The only thing you can do, AFTER you become a citizen, is to have a ceremony in Cambodia, but not civil one, while filing for the I-129F. Maybe if doing this year you could have an interview scheduled for when you´re there in January (if you´re lucky with your Citizenship plus the I-129F. Then you can come back with her after the big ceremony (not a marriage marriage) and have a civil wedding in US. That would make one trip for you only, to go there.

The other options you´re considering are illegal.

Others have obviously answered that it is NOT ok to get married while filing the I-129F. One thing that I'm not sure you're aware of (but you could be) is that once you are married you will have to file for Advanced Parole, which could take 2-4 months or more to get, so she will not be able to leave the country until she has this. So, any weddings in Cambodia would have to wait a few months after your legal wedding here in the states.
