A close friend to mine and her husband married here in the states and he went back to Spain to wait out the visa process. They completed the IR-1 application and sent if off the later part of August. She has not received her NOA1 nor has her check been cashed. She also misplaced the tracking receipt. She has repeatedly called the MIS-information line only to be told they would be unable to assist her until it had been after 90 days!! First, I introduced her to visajourney.com and then I suggested to her to cancel the check and resubmit... Was this good advice??

Bad advice. The USCIS is listing the dates that the various centers are processing the applications. California for example, is only at 8/30/07 and Vermont is still working through July applications, so if the I-130 was sent in August I would give it a bit more time before pulling the plug on the original application.

My blog

10/01/2005: Married in Toronto

02/15/2006: Began Canadian Immigration

09/19/2007: Withdrew CIC application (they still hadn't processed anything)

10/01/2007: Moved back to U.S.

----------------------------------------------------------------------------------

IR-1 application through Montreal Consulate

10/26/2007: I-130 mailed to CA Service Center

10/29/2007: USPS confirmation of receipt of I-130

02/13/2008: NOA-1 received (107 days)

07/02/2008: I-130 approved

07/22/2008: AOS filed including EAD and AP

07/25/2008: NOA-1s for all 3 received

08/20/2008: Biometrics appointment

08/22/2008: Received RFE for Affadivit of Support and Medical

10/21/2008: Submitted I-865W in lieu of co-sponsor and medical info to NSC

11/14/2008: online case status not updated since filing of AOS in July 2008

01/20/2009: Received another RFE for Affadavit of Support Info

02/02/2009: Responded to RFE with brand new AOS based on 2008 tax return (if that doesn't shut them up, dunno what will)

Well, thank God she hasn't taken my advice. She's just waiting until the 90 days is up to see what happens. Hopefully, she'll still want to be friends with me. Who wants a friend that gives bad advice ;)

I was talking about receipt as well. The some Service Centers haven't issued NOA1's for applications received in August.

Watch out for USCIS bulletin regarding delay in receipting. They acknowledge there is a backlog, however your priority date will be the time you sent it in. There are hundred thousands filed due to price increase, yours will get there somehow.

We filed our I-130 on August 14, still haven't cashed check and no NOA1 received yet and it has been almost 90 days. We did receive the receipt from the Post Office showing that it was received on August 14; however, it took almost a month for the Post Office to send the receipt back to us. Keep waiting -- especially if you mailed to Vermont. Good luck.

Same here. Our petition was received by Vermont on 08/03/07 and still no check cashed nor did we get a NOA1. So, your friend will have to do the same as all of us: sit tight and wait. By the way: USCIS says that it will take up to 15 weeks so there is no need to call after 90 days. They will only say that they are still working on the pile of petitions ahead of your own case.
