The other day we got a pink letter from USCIS about our adjustment of status case, and it's left me incredibly confused. They are requesting more evidence about the following (keep in mind that we sent ALL of this to them already):

A. Supporting tax documentation (w-2's, etc) in regard to I-864. <I'm guessing this is for my dad, who is a co-sponsor; and we have already sent them this>

B. Supporting tax documentation (w-2's, etc) in regard to I-864 <Yes, they put this on there twice using the same wording. I'm guessing this one is for my mom, who is also a co-sponsor, and we sent them this too.>

This one is the most confusing though...

C. "The joint sponsor on Form I-864, Affidavit of Support, must be a United States Citizen, United States National, or Lawful Permanent Resident of the United States.

In order to process your application further, submit evidence of the joint sponsor's status."

Okay, both the joint sponsors are my parents, who are most definitely US citizens. USCIS has complete I-864's for both of them, their tax info, their social security #'s, everything. What could have possibly happened to make USCIS ask for more resident evidence?

I'm pretty sure they just flat out lost a good portion of the paperwork we sent them, but how can I find out? I tried calling the number on the letter they sent us, and it is just for ordering forms. I called the USCIS main number and they lady said she didn't have any additional information. I'm totally lost here. I think I should just have my parents re-do their I-864's; but is there anything else I can try? Or a number to someone who can give me more information?

Sorry that happens to you. Don't feel bad tough, it happened several times before. What you have to do is send whatever they ask you to send even tough you already sent them. Secondly, in order to prove that your co-sponsor(your parents) are US citizens you have to send a copy of their us passport or certificate of citizenship. I think that's the only way you can prove that. And Good luck

Exactly. You're going to have to resend everything and include a copy of their birth certificates or whatever proof they have of being Citizens/residents etc. I paper clipped my co-sponsors birth cert to her tax returns to keep it all neat and organized and then included a cover letter explaining where and what everything was.

Yep, resubmitting the forms would probably be the best thing to do I suppose. I just hope it doesn't happen again. You'd think the recent price-hike would make for some faster/better service...but oh well. Maybe I'll include a loud buzzer with this package so they can't loose it :innocent: Then again, that's probably a bad idea.

Another question I have is does this effect the time it will take to get her work card? She's really getting depressed sitting around the house all day and she wants to work.

Agreed with the others, re-submit the forms along with proof of citizenship. Didn't you make copies of everything? You don't need to write the forms all over again, sending copies should be enough. And if you don't have copies, make sure that you make them this time!

As for work, it often takes weeks and months to get a job, why not have your wife start giving job applications and go to interviews? They only require the EAD by the first day of work. By that time, hopefully she will have it in hand!

Another option is to have her spend time doing volunteer work. Try : http://www.volunteermatch.org/

My hubby got a great accounting job (volunteer) through this website and it kept him happily occupied for many weeks, while he was waiting for the EAD!

This is becoming common with the USCIS. Just send them what they want (again)

Something like this happened to us. USCIS claimed that our AP application had missing information and whatnot. I made an infopass visit and asked the fools there to show me where I made a mistake. They showed me the note saying I didn't do such and such, I literally pointed to them where I did such and such and they still refused to accept that they made mistakes and said that we would have to resend the AP application.

We were about to resend it when we thought otherwise and opted to save $170. A few weeks later we got the Green Card interview.

USCIS and expecially the Infopass offices are full of really, really stupid people.

Hiya. I agree with what everyone else has said..send everything they ask for plus anything else that might be helpful and CLEARY list it on a cover sheet.

We recieved a similar RFE..so I mailed back a lot of double information.

I must say that we recieved Chris' EAD very shortly after that, and if you look at our time line it didn't seem to affect how long we waited for our green card. We just got his "welcome letter" earlier this week. Of course every case is different!

Continued success! :star:
