Is visiting the US during K-1 Visa in Process allowed?

Hi All! My finance, a Japanese citizen, would like to visit the US to be with me (in New Jersey), but we have a K-1 Visa in process (about the 5th month now). We thought she had to get a Tourist Visa, even though Japanese citizens can enter under the Visa Waiver Program. She was unfortunately rejected from getting a 3.5 month Tourist Visa (US Embassy didnt believe she would go back to her country :wacko: ).

Should she still attempt to travel to the US without a Tourist Visa?

If she is rejected again at the airport, will this negative record impact the approval of our K-1 Visa?

Since the K-1 Visa takes 6-9months to complete, should we play it safe and wait until the process is done?

Hi I'm new but from what my bf has found out from his lawyer is that is better for your fiancee to stay in Japan until the process is completed as they will probably not let her into the USA when a K-1 is in process.

Hi again after reading more i see that people have commented that it is fine to travel in and out of the USA so long as she has proof of ties in her country and not intending on staying . :yes: That is a good one for me too because i was worried about it too not being able to see my bf for months on end... so i'm dancing around after i found that :dance:

i wend twice after we send off the petition, i had no trouble at all at costums. it is fine to visit. read the thread for some tips.

I'd just like to add that if your fiance does decide to try it and gets turned away at the POE it won't have any impact on your K1.

I'm so happy that you guys are all saying that there is nothing to worry about on visit my fiance in US.

BUT, do you think I can still pass the immigration even my tourist visa got reject before?

Does anybody passed the immigration after the tourist visa got reject??

I wouldn't say that there is "nothing" to worry about. I know of a few who tried to come for a visit during the process and were rejected at the airport and sent back, but some have no trouble at all. Each case and approving officer is different. Being that they denied your tourist visa already, they may deny entry based on the same findings...not enough ties to make you go back to Japan.

I haven't heard of anyone having trouble getting their K1 visa approved due to being rejected on entry to the US, but it's up to you to take the chance.

My fiance and I decided to wait until the process is over and he moves here. It's hard to be apart, but we have the rest of our lives to be together.
