I -864 W2s

Hi.... I need to clarify something abot the I-864 that we can't understand yet!!!!! In the instructions they say that you need a copy of your last 3 years of tax returns and you may also be required to send the W 2s. We then read the instrutions and they say that you only need the W 2s if you have a joint filling. So, suppose you file the taxing "alone" you are not required to send the W 2s right?

My husband joint sposnsor is not married and therefore he couldn't joint fill. Does he need to send the tax returns only without the W 2s?

If he is th eonly one on his tax returns....then that is all he has to send....we learned the hard way

yup my husband is only sending his tax return transcript as i am not on it for 2005. my father in law is our co sponsor and has to send his W-2's along too cause my mother in law is on their jointly.

Ah ok Its clear now finally....so basically my husband's uncle being single only has to send the 3 years of

tax return. Another question: they say the sponsor or joint sponsor has to be 125% above the poverty line. Translating this into "normal words" how much is per year? Immigration told me 16000 or 18000 I foorget now. Like our joint sponsor made 50000 last year (2005 taxes) do you think is above the poverty line? In Italy it sure is ehehehe

Damn Stina... you sure know your stuff!! lol My husband's uncle is single, he makes money but still lives with his parents. Do you think this counts as 3 people or just him? I am not sure If immigration means parents too ehehe. So since he lives with his parent we can but a family of 3 so 20,750 plus how much per person in this case? 3,400 or 4,250?

Hey Maria,

This is a toughie lol... Is the uncle living with the parents because he is taking care of them, like are they his dependants, or is he just living there? If he is just living there, making his own income, and his parents arent dependents on him, then I believe you would not include them in the affidavit.

Perhaps someone else out there can give their input as well who may have been in this situation, but IMO, if they are not dependant on him, then they dont need to be put on it.
