I-130 approved but I-129 not yet??!!?!

Holding the I130 is a procedure that they stated they were implementing a while back (June 2006 if memory serves), but they were struggling to get it implemented. Just a little while back, if they didn't connect your petitions before the I130 was approved, both would make it on to NVC. Jas was one of those (and there are several others in the last few months that had the same thing happen). In fact, DivineMercy did have her I130 forwarded to NVC, but she is waiting for the I129F because (again if memory serves) their embassy has a huge difference in the wait times for CR1 vs. K3.

My I-130 was sent to the NVC back in July, they sent all the info for me to reply to and pay bills and all that ####### but I decided to wait for the K3 because the embassy in Lagos, Nigeria schedules K3 interviews 2-3 months in advance while the CR1 interview is set 10 months ahead. I didn't want to risk the CR1 getting there first, I'm happy I did that because the K3 is taking forever, chances are the CR1 would have won the race.

A few months ago I was told by USCIS mis information line that I am no longer eligible for the K3 because my I-130 had been approved and forwarded to the NVC. I called the NVC and they said don't listen to that, its still pending at VSC and that's how it will stay. But now that they are pairing them together I'm wondering if they are ever going to approve it or just assume I went for the CR1. I'll have to call them using the RFE trick on Monday and see what kind of answers I get. I'll let ya know. If they say I can't get the K3 now after waiting all these months... I might just lose my mind.

I understand your frustration, and the daily insanity of checking your emails and the USCIS Website for updates. Since my I-130 was approved first, just like yours, I was also told that I could no longer pursue the K3 (I cried, believe me) by an idiot at USCIS. It makes me very furious that we are in the hands of people who don't care, people who don't have accurate information, and we are at their mercy. We depend on the information they provide, but when they fail to provide us accurate information that's when we are hurt. The mis information they provide may force us to make wrong decisions.

Please hang in there and have hope and faith...pray a lot, that will help and give you peace of mind. Stay strong....for your sanity and for the sake of your children. I bet your kids won't like to see their mommy sad.

5.24.07 - I-130 Received in CSC

7.14.07 - Received NOA1 (WOW after 6 weeks, I was worried...called INS and told me CSC had a computer "glitch" causing delays on printing Receipt notices and approvals)

10.30.07 - APPROVED No email, the NOA2 came in the mail...hard copy.

***1-129F***

7.23.07 - I-129F received in Chicago

7.30.07 - Received NOA1

11.21.07 - APPROVED!!!! APPROVED. GOT AN E-MAIL ON THANKSGIVING!

03.03.08- INTERVIEW IN CIUDAD JUAREZ. VISA GRANTED ON 03.03.2008

***AOS & EAD***

3.10.08 - Case Received at Chicago Lockbox, check cashed 3.14.08

3.17.08 - Received both NOA's in the mail

3.21.08 - Received Biometrics appointment letter in the mail, biometrics Appt. 4.02.08

5.05.08 - EAD Card Production ordered GOT EMAIL (we received the same email on 5.09.08)

5.13.08 - Approval Email for EAD (so the card was ordered first, and then we were approved...hum)

5.15.08 - EAD Card Received in mail.

8.08.08 - WE GOT OUR INTERVIEW APPOINTMENT YAY...9/12/08 - INTERVIEW APPROVED

9.24.08 - Received Green Card in the mail YEAH!

***I-751***

6.15.10 - Mailed I-751 Docs to CSC, check cashed 6.24.10

6.26.10 - Received NOA in mail dated 6.21.10

6.29.10 - Received Biometrics appointment for 7.15.10

thanks YGandMat, God has provided me with an enormous amount of peace of mind lately and I'm so grateful for that, otherwise I may have gone postal on those people!

I try to remain calm and matter of fact about the whole thing to the kids but every once in a while they'll catch me crying and they know right away why. It will be over soon (I hope). At this point November is pretty much out. I did look up cases like this in the stats on VJ. I haven't seen anyone get an I-129F approval months after getting an I-130 approval. Either they are still waiting, didn't fill in their timelines or abandoned the K3 in favor of the CR1. I'm trying to find evidence that VSC actually does approve I-129F's after having already approved the I-130 and forwarding it to the NVC. Anyone know of any such cases?

Call the regular USCIS number and follow the prompts as if you are getting an RFE (as if they asked you for further evidence) your call will be transfered to the service center where u get to speak to a person with a little more competence than the misinformation line gives. It may (depending on whether the website if functional or not) give you a touch because of the call since they have to look into your case.

It may (depending on whether the website if functional or not) give you a touch because of the call since they have to look into your case.
