RFE FOR CRIMES NEVER COMMITTED!!!!

The USC petitioner needs to handle the problems with the file. For several reasons.

#1 - It's his petition.

#2 - He can get and collect the appropriate documents. She cannot.

#3 - It's his DUI. He needs to man-up and handle the situation.

Thanks Rebeccajo but it clearly says that it is not an issue unless he has 3 or more....and remember that the DWI is over 10 years old.

I'm still looking for a lawyer.

Of course it's his petition but we are in this together, we are a couple and I can't just sit and wait without doing anything. I'm gonna try to do whatever I can from where I am to make things easier for the both of us, especially for him now that I know that it's not a good time for him.

I know I cannot collect anything but at least I can be more informed of what to get and where to go.

Good thing he remembers where to go to get the same documents he got for the last petition.

We are also gonna get a Personal Criminal History Record, fingerprints, by the state of NY. Thanks to Frank for the info! I really appreciate it.

But now it is an issue.

While you might want to help, the practical fact remains that your fiance needs to handle the situation. Bad time for him or not. I'd probably be asking him which were more important - the visa petition or his blown engine.

While you might want to help, the practical fact remains that your fiance needs to handle the situation. Bad time for him or not. I'd probably be asking him which were more important - the visa petition or his blown engine.

He surely needs to handle the situation but any and all information you can gather for him would be of great help. I think you are doing great by researching and weighing your options so that you can later contact him with your findings. This teamwork makes for a great couple. You will both grow stronger from this.

And this situation is not about a DUI but an error.

Alright, Patrick called VSC and this guy told him just to send what is required, to mark NO where is is required and write a letter. That's all, he said they have the rest on file.

Then I'm gonna start a letter.

I said let's just get this three docs we got the last time and send them but he says they have everything on file, they don't need it again.

Thanks for all the advice everyone and I think we are gonna do what MR. KNOW IT ALL and the guy from VSC says.

Thanks julezabelle. He said they read the letter together and the guy explained what to do, answer NO to that question that he must forgot to check but he doesn't remember and to write the letter.

Whoa!

You have a lawyer. You are paying the lawyer, correct?

If the lawyer will not or cannot assist you - GET ANOTHER ONE.

I think the problem here is potential for the perception of material misrepresentation on your part - something which can result in denial of this petition and any future petitions.

I don't know if you withdrew your previous petition, but that should also have been done.

You've had some good suggestions here on how to handle this, but I wouldn't take one step forward without consult from COMPETENT legal counsel. And if I had paid a lawyer and he had already caused me an RFE, I would be in his office wanting his head on a platter.

PS - Infopass is fairly pointless at this stage of the game. And you can't phone the service center. Your only option is to answer the RFE.

I agree with Rebecca on this one. You received an RFE and havn't even consulted the lawyer. Why take a chance with something so important when one petition has already been denied? Seek legal advice and have the lawyer sort thru this before you get denied again.

It's easy to say consult the lawyer but it's hard to find one that can finally help, personally I hate lawyers that don't do their job the way they suppose to.

I always like to take care of the stuff by my self, I don't trust just anybody.

You have received some excellent advice, I still feel that your case is one that should be sent to the ombudsman to look at - that office is just trying to understand where all the problems lie in the various centers, and then make recommendations in to the USCIS for making systems run smoother.. without our input the whole system will never change..

So since I can't seem to correctly Link in :blush:

I have tried again... , about half way down the page is the information about contacting the ombudsman or the one for case submissions...

I'd be more tempted to send the Ombudsman a synopsis of my case AFTER I had a successful decision.

The Ombudsman cannot speed up individual cases.

I'd add that the problem the OP is dealing with was not caused by deficiencies of the system, this problem was the result of a mistake they made that got worst when they tried to fix it due to this lawyer's misleading advice.
