Hello,

My sister has been living aboard for a year now. She wants to move back to the US and is trying to get her husband a visa. Since she has been over seas she does not have an income for 2007. How much? assets does she need to show if she doesn't have a current job in the US? Someone told me it is 3times the amount of the household size of 2 which is $17,800. So the amount without assets would be $53,4000. Can this be correct?

If she hasn't filed yet she may be able to do a DCF.

Assets alone aren't valued that highly by USCIS.

It would be much better for her to get a co sponsor.

Yes, three times is correct but there is never a guarantee that meeting a minimum standards will result in a visa. A joint sponsor is a good idea if one only exceeds the minimums by a modest amount.

Yes, three times is correct but there is never a guarantee that meeting a minimum standards will result in a visa. A joint sponsor is a good idea if one only exceeds the minimums by a modest amount.

For assets, it is 3x the minimum poverty level for the family size for a spouse's visa. It is 5x if sponsoring someone else. These assets must be easily convertible to cash within one year without undue financial burden for her or her family. Such assets are: Checking and savings accounts, CD's, stocks, bonds, etc. If she has any reportable income in the most recent tax year (2006), they subtract the income from the asset requirement prior to the multiple.

While I agree with pushbrk that meeting the requirements does not guarentee the visa... they accepted my Form I-134 (Affidavit of Support) without question, but we got the blue slip anyway because they wanted me to write a hand written statement about my first visit (out of 6 visits): 2 visits before the marriage and 4 visits after the marriage... they still must follow the income/asset guidelines. If not, the overcome should be no problem if the income/asset combination is well-documented and exceeds the minimum requirements. I just hope the very best for your sister and her husband and that the visa is soon issued. My wife's should be issued in the next 3 or 4 weeks..... I hope (if my hand written statement is sufficient for the overcome).

Just to clarify, the amount of ASSETS easily convertible into cash within one year without undue financial burden must be $53,400 for a spouse's visa for a family of 2 (her and her husband). Reported income in 2006 reduces this amount (there are no tax returns for 2007 yet as the year has not ended). Her husband's documented assets can also be used in addition to your sister's to meet the asset requirement.
