My friend's fiancee was married within the 90 days but her I-94 is expired (the 90 days are up) and he is just now filing for the adjustment of status etc. Is there a problem if his fiancee is flying around the U.S. with an expired I-94?

It's fine to fly WITHIN the U.S. but in order to leave the US and come back you have to have advanced parole.

I was just wondering if someone saw an expired I-94 if that would pose a problem even within the U.S. We are all planning to go somewhere together next week.

I would think it would be easy to fly around the US, but just recently my husband was pulled over by the border patrol here in Tucson and was given a warning that he should be carrying his passport at all times even though his K-1 has expired and we are currently in limbo with the AOS paperwork. I think it would be safe to carry along some paper work just in case you are harrassed by some airline worker.

Not a problem. Even after you mail the AOS package, you still won't have any proof of it. You'll get a letter in the mail a few weeks later - that will be it. ( Oddly, that letter was considered valid ID here in Florida for the DMV, but not an EAD, I-94, or anything else).

If anyone asks, say you have a pending AOS (green card) application. The K-1 in your passport and marriage certificate should be enough to keep you out of trouble with INS, should you run into them.

I would agree with the above, there was a post from someone who did encounter problems, but the Passport and AOS receipt sufficed.

To avoid any issues, open your passport at the penultimate page so they can just look at it rather than leaf through it.
