My RFE is in for further review because the CO is blind.

They're requesting two things:

1) According to the CO, my country of domicile wasn't listed. Being a VJ member, I made two copies of my package on the day I sent it to NVC. My country of domicile is indeed listed.

2) On my co-sponsor's I864, they're claiming that the household should be 3, that my co-sponsor is married. Well, no, she was widowed in February.

Montreal: BEAT!!! Approved!!!!!

I can see how there might be confusion with number 2. I assume you sent their 2008 tax return which was probably a joint return? The country of domicile one is strange.

I did send the 2008 return, which was joint, but I made a giant paragraph on my cover letter stating that her spouse had died in February. She had also written on the I864 that her spouse had died. It was in two different places, clear as day. So either the CO didn't read the cover letter, or just didn't care.

The domicile thing drives me nuts. What I'm wondering is in the Place of Residence (#13), I put "n/a" because it isn't different from my mailing address. I'm guessing the person didn't see the "n/a". Who knows.

No worries, Mal. You just have to go back and forth with them until they understand what's going on. I had to resend my DS-230 because I printed up the PDF and I couldn't type "Present" at my present residence, so I left it blank -- they didn't like that.

My legal team even got into a verbal yelling match with one of the NVC operators because we followed the I-864A information according to NVC instructions to the letter -- only to have them say our household information was wrong. So, they literally told us to send the form in, SCRIBBLE OUT a few portions of it, and then once we write information over that, they'll accept it (which they did). They also requested information from us that people previously didn't have to present until the interview (they said they were able to take pretty much everything in now).

It can be a pain going back and forth with the NVC, but at least when the case is complete they have all the information they need. I haven't seen my poor long form birth certificate for months; I think he's definitely overstayed! haha

Dawg, your poor birth certificate! I sent my hubby's original LF and he was so upset to lose it. He was all, "what if I need it?!" Then I laughed at him. He has a passport, the goof.

I kinda bit myself in the #######, though. I sent my case for further review. I'm wondering if I should have just sent the damned information or not.

That ain't nothing. The NVC lost my original long form from decades ago a few months ago, so I had to get one rushed to me from Thunder Bay to send to them via my lawyer in NC! I keep my short-form in safe place, so I'm not too concerned.

Yes Mal, it does sound like the person who looked at your file didn't actually know what they were doing. I think you did the right thing by sending it for review, when I did that it only took them a couple of days to get to it and get it back on track - whereas when I had to send in additional information - it never got back on track (hence having to send it for review!)

I too got an RFE for not putting 'to present' on the DS-230, that was my fault and I accept it - I did in fact know I needed to write that in and promptly sent it off blank.

That is very frustrating! We had RFEs from both the USCIS AND the NVC for my husbands divorce document, which we for sure included in both our original submissions, along with cover letters thoroughly explaining what was included in the package we sent. I think because it wasn't from the U.S., they didn't bother to carefully go through all the docs to find it. Overall, I think our case was probably delayed an additional 2-3 months because they weren't thorough, so I know how you feel. Now, we've been waiting for an interview appointment for almost three months with no word.

Good luck with your response to them. You should be able to just write ANOTHER letter explaining AGAIN what the situation is and get a quick approval. I hope everything goes smoothly for you. :)

There is a lot of talk about cover letters, I would almost bet that most of them end up never being looked at. The reason I say this is that I don't think that is the way COs are trained.

When I was documenting my U.S. citizenship - working with the consulate here in Calgary, I made up a sheet one time - basically a really basic family tree. The person I was working with is the supervisor. So I present this to her because I do not expect her to remember all this stuff and the family tree is the basis of a claim to derivative citizenship.

I gave it to her, she glanced at it and pushed it back at me and said, I don't need that (then proceeded to clarify all the relationships again i'm sure :lol: )

So while to us a coversheet with enclosures etc seems like a good idea, they probably either throw them away or just put them on the bottom of the pile.

If there is an explanation to be made it should be attached to the back of the form it refers to, nothing more.

ie: back to 'just the facts' and only presented in the way they say.

You would think they would clarify if they wanted cover sheets or not.

Mal, that was a good idea to have them look again before sending more docs. They gave me 2 RFE and I called to talk to supervisor after the second one, because it was concerning an issue that they could've included in the first one...it was clear that they have a step-by-step guide they follow and do not move on to the next step before they OK'ed previous checks. On the good note though, my case never ended up in that 2-3 day long process of final review. The moment they received the info case was completed.
