IR1 / CR1 - Montreal Timeline to Interview

So happy news!!! We received our letter today! =D Our interview is October 13, 2008 @ 8:00am . looks like they changed a bit of how the medical is handled but no complaints here. I was suprized that they left three weeks in-between lol i was expecting 2 months! But i'm happy! I was getting worried.

Just for curiosity sake, when did the NVC finish your case for the CR/IR visa? I looked at your timeline and you have Vancouver as your consulate, but they don't issue CR/IR visas, so I am guessing you applied for both a K visa AND CR/IR? Is your interview in Montreal?

@Dalene We actually filed directly at the consulate in Calgary. So our NVC time-line was non existent. There was no option to choose Calgary. =P

The consulate is actually either Vancouver or Montreal - so interviewing consulate rather than where you filed

Thank you Trailmix. LOL I was always confused about which consulate that list was referring to, the filing consulate or the interview consulate. My head is spinning with so many preparations now! =D

I've got an issue..

My sons I 130 will be approved later this week but he will be turning 21 in December, so what now? Ive been told that I as soon as I receive an NVC case number I should call them and ask them to expedite things. Will this really help or what else can I do to ensure a timely interview and a visa? I heard there are serious backlogs at the Montreal consulate so what happens now? :S

(I read about writing to the NVC from the Dept. of State website about this issue)

I don't know if you need to write to the NVC or not, however since you read it on the DOS site, absolutely I would.

Basically he is probably covered by the Child Status Protection Act

"Under the CSPA, if you are a United States citizen and you file a Form I-130, Petition for Alien Relative, on behalf of your child before he or she turns 21, your child will continue to be considered a child for immigration purposes even if the USCIS does not act on the petition before your child turns 21.

For a more detailed explanation of the CSPA, please review both the guidance memos, H.R. 1209 – The Child Status Protection Act, August 7, 2002, and The Child Status Protection Act, September 20, 2002, on this matter.

If you need further information, please call customer service at 800-375-5283."

Hmm I remember something about that, but the thing was that I thought this was as long as the file is WITH the USCIS "even if the USCIS does not act". At this point, they have acted (approval). So i'm not sure if it applies. But regardless i'll still write to the NVC in hopes of getting things to move along at hyperspeed lol... hopefully this whole ''turning 21'' thing helps my son get a visa much faster than normal... lets pray to god?

As for the DOS website here is whatit said:

Children who will turn 21 within 60 days

If any of the applicant’s children will turn 21 within 60 days, please contact the National Visa Center immediately.

Note : If visas will be available in the applicant’s category prior to the applicant’s son or daughter’s birthday, we will expedite processing of the applicant’s case in order to ensure that the applicant’s son or daughter will be able to immigrate with the applicant. Unfortunately, we cannot assist the applicant if visas are not available in the applicant’s category prior to the applicant’s son or daughter’s birthday.

I kid... it is what it is, really. I'm happy to see people getting their dates, the ONLY frustrating thing is that there is zero consistency

and no rhyme or reason to how Montreal works their shenanigans...
