OMG I messed up my I-130

Timeline

I was catching up on some filing here at the apartment when I decided to read the I-130 that I just submitted. I signed it at the very bottom where the spot is for the person completing the form if not the petitioner!

*sigh* I so suck.

Should I resubmit now and if so, what do I do about the original?

08/20/2008: Biometrics appointment

08/22/2008: Received RFE for Affadivit of Support and Medical

10/21/2008: Submitted I-865W in lieu of co-sponsor and medical info to NSC

11/14/2008: online case status not updated since filing of AOS in July 2008

01/20/2009: Received another RFE for Affadavit of Support Info

02/02/2009: Responded to RFE with brand new AOS based on 2008 tax return (if that doesn't shut them up, dunno what will)

02/19/2009: EAD card received in mail (no updates on Online Case Status ever made)

02/23/2009: AP received (again, no online updates)

02/26/2009: Received interview appointment letter for 4/6/09

04/06/2009: AOS approved for unconditional GC

04/21/2009: GC received

From what I've read, from other VJ members who've noticed mistakes after they've mailed things in....it's best to wait to have them either return it to you, or get your RFE. It seems like it's a colossal mess when you send things, with instructions, and try to get them to match it up with paperwork they've already received. Matter of fact, I don't believe those that have mailed it in, in an attempt to get it matched up with prior sent paperwork, it has ever made it...

Well they noticed. I got my whole I-130 packet returned to me today as rejected. Go figure that I waited 90 days and I should of gone with my gut and resubmitted. Now, its like we never submitted anything. I am so upset right now, I cant even explain...

I guess other than submit a new copy of the one page, I am struggling if I should tell my husband or not.

Sorry Delicia. I don't know that we thought you shouldn't resubmit because it might go through without fixing...I just think that when people resubmit, before getting it back, things can get really screwy. Two applications, and never the two shall meet, you know? Of course you should tell your husband. My word girl, you've been under SO much stress, I can't believe you haven't made any mistakes. You need to be good to yourself! Stop berating yourself!

Resubmit the application, take a nice long bath, bubbles of course, a glass of wine, maybe a candle...and soak.

Hey Delicia,

Don't beat yourself up about not resubmitting when you noticed the signature thing, like Carla said, you never know - if you did resubmit, it might have made more of a hassle.

Case in point - I received an RFE from NVC. Decided to use a shortcut and send in the info. Received the hard copy RFE and found the operator hadn't told me about submitting my Husband's PR card as well, I sent that overnight the next day with all the good identifying cover sheets etc.

I know they got it, however then my application just sat there, they sent me another RFE for it and the operators said ignore it - etc etc etc - after submitting it again with the RFE coversheet and speaking with a supervisor, it was finally looked at and approved.

Anyway, I think that may have added about a month and a half to processing - of a file that was already accepted (I would still do it again mind you haha).

So, my point is, it could just as well have turned out that you had 2 applications processing at the same time, or that the first one was accepted and then they receive the 2nd one and see you already have one in the works and it becomes an exception and sits even longer on someones desk - you see what I mean.

Delicia, I don't know if this will help or not, but there is a couple on the October Filers thread who had their entire petition returned to them because of something (forgetting to sign something or making out the check wrong, I can't remember what), and when she resubmitted it, they gave her a receipt date that was the date the original rejected petition was received. They process them in order of the receipt dates, more or less. That was for a K-1, but I would think they will handle it similarly for you, and if that's the case, you've not lost any time.

So I told my husband about this unfortunate turn of events. There was dead air on the other end of the line. I was just going on and explaining what happened and reading the NOA to him and after awhile, still no response. I told him I was going to go kill myself with a nail clipper and hung up the phone.

About 20 mins later he called me back and all he could say was that he was glad it wasn't his mistake. We ended up laughing over how I would react if the application was rejected because of how or where he signed his forms and now, we have booked a ticket and he will be here in mid-February for a short visit. Hopefully, I will have better immigration news for him by then.

I'm just wondering, with your NOA, did they assign a case number?

Yes, my NOA-1 has a WAC number, but it has no priority date. Under Notice Type it says Rejection.
