AOS - request for evidence - IRS return question

Hello all,

My husband is currently going through the AOS process; I'm acting as his sponsor, and my dad is acting as his co-sponsor. I recently received a request for further evidence, worded like this:

'G) In order to process your application further, the sponsor on form I-864 must submit all supporting tax documentation submitted to the IRS for the most recent tax year

I) The joint sponsor's income on the Federal income tax return does not meet or exceed 125% of the poverty guideline <this is confusingly worded, because he didn't send an income tax return - he's on disability, so he doesn't have to complete one>. The joint sponsor's current income listed on Form I-864 is sufficient; however, no evidence has been submitted as proof of current income. In order to process your application further, submit evidence of the joint sponsor's current income'

A couple of questions:

1) Re the first part - I've already told them that I was at university during the past tax year, and I've only been working in a part-time job for a month or so - I mentioned this on the original form, stating that this was why I couldn't provide my tax return for the past year. All I can think of is telling them again and cutting and pasting the relevant section from the IRS website saying people earning under a certain amount/unemployed and in education don't have to complete an IRS tax return. Does this seem like it would be enough for them?

2) My dad (who is acting as co-sponsor) receives disability, a pension and income from investments as his sole sources of income. He provided documents giving details of these. As he's on disability, he doesn't have to complete an income tax return - should he tell them this again, cutting and pasting the relevant wording from the IRS website (stating that people on disability don't have to complete an IRS return)? The original documentation he sent as proof of income consisted of a letter from the Social Security Administration detailing the amount he received + copies of his three annual investment return statements - this total amounts to more than the 125% of the poverty guidelines. I don't know what they want us to do - what other evidence could we provide? He's also provided details of his assets on the original form, just in case there was any problem with income (though it's my understanding that disability would be a valid source of co-sponsor income). Any advice would be appreciated!

thanks,

Luisa

Pops should have received a 1099 from SSA.

Plus!

(stating that people on disability don't have to complete an IRS return)?

Not true if they are making above the alloted amount!

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

!! ALL PAU!
