Almost 40 days now...

Timeline

Nearly 40 days and check is not even cashed....

I've noticed some other VJer's that have sent their petition in around the same time I did and their checks or money orders have been cashed. USCIS's website also says all initial data entry should have been done by now.

Now is it time to worry? I know there are delays and all that, but the fact that my check hasn't even cleared yet worries me a lot. I would think the first thing they want is to have 455 dollars more, then get around to the NOA. :angry:

Anyway, would you give them a phone call by now? Has / is anyone else experiencing this delay? Where would I place my call to?

Mine wasn't cashed until about two months after they got my petition. I wouldn't worry about it! Just be patient, and good luck on your journey!

I'm in the same boat, they have a 90 day policy which I tried to get around by being vague about my dates ie. "well i sent it this summer and I was told last week that I'm authorized as of today to call". Problem is they still won't let me through unless I openly lie and give an incorrect date. So if your willing to tell them you sent your forms in back in August 2nd or 3rd they'll pass you on to CSC. I'm alittle leary of doing that as of yet. I'm probably going to wait another week ot two yet.

I've tried probing into what happens after the 90 days. I think they start an investigation that takes a couple of weeks and if its not found your out of luck and have to resubmit and you don't get to jump the line to where you should be had they not lost it. Again I trust nothing I hear from USCIS so take that with a grain of salt.

I know this is overreacting but I wonder what would happen if all the people on this site with the same application joined together with a class action lawsuit? There are between 10-20 suites each year and while they never get to court they do get the application through. That being said most of the suites involved people who have suffered for years at the expense of the government due to long background checks etc, not delays of a few months.

After 90 days, they're just willing to patch you through to someone who knows enough to actually get some information about the case (ie - an immigration officer). They likely have your case, just haven't done much with it yet.

I should also mention that I was lucky once to get a nice person at USCIS who patched me through straight away. Unfortunately I was only on day 30 or so and they hadn't processed it then. So thats 1 person out of about 6. With those odds you might get someone who can help after calling multiple times. The way I see it, if there unwilling to help why not tie up the line constantly trying to get info, they owe you that much at least. And until you have a reference number they don't keep track of your calls.

I was on the 2nd CIS Ombudsman teleconfrence yesterday and they are still working on the receipting delay. They had projected all cases would be marked rcv'd as of 10/31, but the Nebraska svc center is still behind and USCIS still has not provided the rcpt'ing and processing updates the Ombudsman has been req'ing for 4 months. He advises you call USCIS. If your check is not cashed within 90 days (some banks wont honor the check after 3 months) USCIS should still give you the opportunity to send in a fresh check without a penalty/denial, etc. (according to the Ombudsman).

That does seem to be a long time...but the process date usually starts when they recieved your packet, not when they cashed your check, so that's the good news I guess. Once you see that your check has been cashed, they stamp your case# of the back of the check, that way you don't have to call in to get it. Once you have your case# or reciept#, you can enter it in online at thier website and they'll give you your process date.

Trust me...I know this is so frustrating....We're in this mess too...but I don't think there is much you can do to speed it up. If it's any help, our process date was June 5th and we were approved in October, 2 months ahead of time, so sometimes things do move a bit faster than you think.

Our time line:

06.10.05 - fell in love in Hawaii

06.14.06 - met his family in Germany

03.15.07 - engaged

04.31.07 - sent in 129f

06.05.07 - recieved by CSC

08.20.07 - called because NOA 1 never recieved

09.27.07 - NOA 1 recieved

10.03.07 - visa approved

10.06.07 - my fiance goes back to Germany

10.11.07 - NOA 2 recieved in mail

11.11.07 - going to see my love in Germany!!!

11.12.07 - packet one recieved in Germany (same day I arrive, woo hoo!)

11.13.07 - sent packet one back express one day delivery

11.23.07 - packet two arrived with interview date!! (day before I left, woo hoo!)

11.24.07 - so so sad, back home without my fiance

My fiance never received the NOA1 in the mail, so he called the USCIS's 800 number (it took him awhile until being able to talk to someone :( ) I think you can them call after 30 days after you sent the petition (maybe 45? :unsure: ) Once you get in touch maybe you'll be able to find out how you are doing in the process.

I feel your frustration. My packet was received on the same date as you and I heard nothing yet from CSC...no cash check. I hope this give you some comfort knowing you are not alone...there are many September filers feeling the same thing. So far I haven’t call USCIS after reading other posts about the 90 days requirement. However, I did email ombudsman last week but haven't gotten a response yet. I'm trying very hard to be patient but I wish I could have that peace of mind that my file is not lost somewhere.

I hope in the next coming week…all of us that haven’t heard a peep from CSC….will have less money in our bank account.
