My husband and I are planning for him to wait out the IR-1 process in Canada; however, it would be nice if he could come over this summer to stay for good. My son is staying with my husband until the end of the school year and my husband is trying to live frugally (thats a really hard thing for both of us to do) and save up tons of cash for a down on a house here in the U.S. Other than the hassle of having to go back to Montreal for the Consulate stuff, what are the ramifications of doing this? Is the immigration jeopardized as long as he is in the U.S. on a valid visitor visa?

10/21/2008: Submitted I-865W in lieu of co-sponsor and medical info to NSC

11/14/2008: online case status not updated since filing of AOS in July 2008

01/20/2009: Received another RFE for Affadavit of Support Info

02/02/2009: Responded to RFE with brand new AOS based on 2008 tax return (if that doesn't shut them up, dunno what will)

02/19/2009: EAD card received in mail (no updates on Online Case Status ever made)

02/23/2009: AP received (again, no online updates)

02/26/2009: Received interview appointment letter for 4/6/09

04/06/2009: AOS approved for unconditional GC

04/21/2009: GC received

No, not a problem at all for him to be in the USA, AS long as he tells the truth at the POE when entering the country! Canadians "may" stay up to 6 months each yr in the USA. If one lies when entering the USA, you just opened up a huge can of worms!! Be honest with his answers, but dont blab away,lol Keep ur answers short and to the point, always use sir/maam, be confident in ur replies. Dont travel with tons of luggage or job resumes and have ties to Canada!! I traveled monthly to DC while my cr-1 was ongoing,most of the time was 4 day trips, longest was around 3 weeks.

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

He wouldn't be able to work during that time, so that'll kind of put a crimp in the saving money category. It'll probably take about a year for the CR1 to be finished processing (at the least) and he can only stay for up to 6 months. He'd still have to go back to Canada to wait out the rest of the process.

You might just be better off to do the back and forth visiting thing until its all done with.

Hi everybody. I love this site. I get so much more info from here than anywhere else. God bless all of you are trying to help all of us. I am abit worried about my visits to the u.s. My husband just rec'd NOA 2 from California for both the i-130 and the i-129f (K-3). I have basically been staying here in Iowa with him since July, 2007. I have been back to Canada 2x's since July for 2 weeks on each visit. I am planning on going back for my interview. Will my lengthy stays in the us jepordize my k-3 or cr-1 being approved? I have been totally honest with the customs agents everytime I have crossed over to the u.s. The last time I crossed was Nov 10, 07 in Sarnia and they did pull me over and I had to prove that I was in the process of applying for my immigration papers. One word of advise to all who are going to be traveling back and forth to and from Canada and the u.s. while you are in the process.....TAKE ALL YOUR APPLICATIONS AND APPROVAL NOTICES WITH YOU!!!!!

04-09-08 - NOA - file transfering to NVC

04-22-09 - called NVC-"haven't rec'd file as of yet". I was told to wait till I get the next action and then write a letter to them stating "will be persueing AOS"

01-22-08 - mailed Package 3 to Montreal (checklist, ds-230 with attachments,

ds-156 filled out application ONCE but sent 2 copies)

03-29-08 - picked up police search results (came up negative....which is good)

02-04-08 - got medical done Dr Seiden Toronto Ontario

04-04-08 - picked up medial results from doctor's office - xrays of my chest and sealed envelope

13-04-08 - going to Montreal by car with my girlfriend-staying at hotel across from embassy, staying for 2 nights

04-14-08 - INTERVIEW DATE - Approved

04-16-08 - Rec'd passport back from embassy

04-21-08 - Port of Entry - Sarnia Ontario

EAD

05-02-08 - Sent I-765 to California

05-06-08 - NOA - California rec'd I-765 (work auth)

08-21-08 - Biometerics appt - took 5 minutes once we got there NOT ENOUGH SPACE TO FINISH MY JOURNEY............
