Definitely consult a lawyer on this one before you start filing. It's always good to get everything straightened out, especially with this kind of complication.

My fiance traveled with me to USA with B1/B2 Visa. However, the INS deport her back before entering US at airport and barred for 5 years under INA 212(a)(9) due to she has intention of staying in US. Can I still apply K1 Visa for her to come? Are there other actions that I need to take? I know I can file K3 Visa for her, but we want to get married in US with my family member present. Please advice.

Uhm at this point even the k3 visa will due you no good, she has a 5 year ban, and they dont throw the bans out without good reasons.

The immigration officers in Minneapols have very bad attitude. They treat us like we are criminals. They claim my fiancee is lying because she carried too much clothes, personal belongings. She was travelling with me but in deed, we didn't plan to get married on this trip. Now, it seem to get married and apply for I-130 then K3 is the only solution for her to come.

If you have read what everyone has posted its going to be more difficult than just marrying and trying for a K3. She has a 5 year ban, which is VERY serious. You MUST consult with an experienced immigration attorney, especially one who has experience with filing hardship waivers.

Even if you apply for a K-3 you will have to list the 5 year ban on there and the chances of the visa being issued are very small. Lawyer up and find out what your options are regarding this. VJers, although knowledgeable, are no substitute for solid legal advice which is what you need for this case.

something's still not adding up for me here... from everything I've heard, a conclusion of 'intent' formed from something like that - too many clothes and personal belongings upon arrival - should result in no more than a denial of entry; there's no PROOF after all, just a suspicion... what on earth would make them add a five year ban on for that? anyone ever heard of anything like this before? I thought bans were for specific offences - visa overstays and the like

and yes, OP - all the very best with it; it sounds like you've got a difficult path ahead :(

Day One: Went to Council of Elrond. Was prettiest person there. Agreed to follow some tiny little man to Mordor to throw ring into volcano. Very important mission - gold ring so tacky.

Day Six: Far too dark in Mines of Moria to brush hair properly. Am very afraid I am developing a tangle.

Still the prettiest.

Day 35: Boromir dead. Very messy death, most unnecessary. Did get kissed by Aragorn as he expired. Does a guy have to get shot full of arrows around here to get any action? Boromir definitely not prettier than me. Cannot understand it. Am feeling a pout coming on.

Frodo off to Mordor with Sam. Tiny little men caring about each other, rather cute really.

Am quite sure Gimli fancies me. So unfair. He is waist height, so can see advantages there, but chunky braids and big helmet most off-putting. Foresee dark times ahead, very dark times.

I suspect there's a lot missing and maybe even an error or two. The OP will probably be more forthcoming when he's sitting in the office of an attorney he's paid.
