Did not change address, now I have questions!!

Timeline

Hi Everyone,

I have a pending AOS (I-130 and I485). Long story short, my husband and I originally lived with my parents in California and we moved to Illinois in 2006. I decided not to change the address and keep the same address in CA because I do not want the paperwork to get lost somewhere.

My parents (in CA) just mailed me a notice from USCIS asking for

- Additional evidence of marriage

- Fingerprint

I have no problem supplying USCIS with the evidence, but they will show our new addesss in IL.

My questions are

-Anyone in the same situation?

-Am I in big trouble?

- What will happen now?

-Any suggestion ??

April 9, 2005 - AOS, EADmailed to Chicago Lock Box
April 11, 2005 - AOS, EADreceived at Chicago

April 19, 2005 - Bio/Fingerprints done at ASC
May 11, 2005 - I-130 transfer to Chicago
June 1, 2005 - EADApproved

August 17, 2005 - AOS interview schedule in Los Angeles

You need to do a change of address ASAP... there are many many people who move during the AOS stage all you have to do it complete the on-line change of address and then follow-up with a call to the 1-800 about 2 weeks later to check that the change has taken place....

Now you will need to change your address.... you are meant to do so within 10 days of moving for the immigrant and within 30 days for the sponsor....

I would also make an infopass appointment at you local office and arrange to get your file transfered and a new appointment for Biometrics in the area where you live now...

I think you may have a slight problem. If I am not mistaken you are supposed to file some form when you move and relocate or even change addresses at all during the wait for AOS green card and then even after you recieve it for first two years until you get a ten year card, and you might be prepared to call USCIS and ask them without giving your name and ask a what if question to them based on your situation and maybe they can help you slide on this oversight, otherwise you may consider a lawyer to handle for you also. Please check but I am very sure you are supposed to file a form with USCIS whenever you change addresses.

Sorry for the vent, it just that it's been such a long time waiting and I just know this is going to delayed it further.

Background

All non-U.S. citizens (aliens) who are required to be registered are also required to keep the USCIS informed of their current address. This is particularly important when you have filed an application or petition for a benefit under the Immigration and Nationality Act and expect notification of a decision on that application. In addition, the USCIS may need to contact you to provide other issued documents or return original copies of evidence you submitted. It is also mandatory for any alien who has been designated as a “special registrant” under 8 CFR § 264.1(f)(as amended by 67 Federal Register 52585 (August 12, 2002) to inform the USCIS whenever he or she has a change of address, employment or school. The special registrant rule is effective as of September 11, 2002. For information about special registrant go to the U.S. Immigration and Customs Enforcement website.

In the past, our predecessor, the INS, required every alien in the United States to report his or her address annually, in January. This requirement was eliminated in 1980 and annual reporting is no longer required. However, if you are not a U.S. citizen, the law still requires that you report any change of address change within 10 days of the change.

I’m a citizen and our interview was on Feb of 2006 that day my husband also got his fingerprints done., On September 2006 we moved (but stayed in same borough) and immediately change our address online, completed and changed the address change form, changed our address at the post office. I check the case online almost everyday. We also call the costumer service # every other month and we had 2-3 infopass since then. The message is always the same “the case is pending at the processing site.” Today we got a letter stamped for the day Oct 25 stating that 2 letters has been sent to informing us of appointments to go for fingerprinting and because he failed to go the application to change status was DENIED no chance to appeal. Also his Employment Authorization was cancelled and if he did not file a motion to reconsider (which cost $585 dollars and one and a half year to approve) with in 30 days he would be deported. We never received those letters. We have all this prove that we have been trying to find get information on the case, so how can we not go to the fingerprint appointments. I talked to a lawyer and she said that it all seems as if it was their error, still there is nothing we can do but to file the motion to reconsider because immigration would still require it. I cannot believe the incompetence of the USCIS. I’m worry because my husband has been in this country for 10 years (6 years with the process) and he misses his parents so much, they are growing old and he wants to see them so badly. They are already telling him to give up and go back to Morocco but I’m an American woman, my family is here, and here is where I want to stay but with my husband. This is putting a strain on my marriage. I need help… Please.

There are potential monetary fines and jail time to any USC sponsor who does not notify the USCIS of an address change within 30 days of the move. If an immigrant does not notify USCIS within 10 days of a move, this is punishable by fine, imprisonment, and/or removal.

Filing the AR-11 address change notice on-line does not change the address of the sponsor or for any on-going applications (like AOS), so you still have to do the I-865 address change notice as well.

I think the admins and/or mods here should sticky Address Change information. Too many people get caught by this and don't file correctly, or don't file at all. There are serious possible consequences to not filing address change notices correctly.

Thanks for your input. I realized now that I shouls have change the address back then.

I have the letter in my hand stating that I have to submit the "evidence of bonafied marriage" within 12 weeks, submit the finger print or it may results in denied.

I guess my question is to what should I do from this point.

1. Change the address AND get the fingerprint done AND send in the evidencce to the California office anyway??

2. Change the address and wait to send it the evident to the Chicago Office??

Also: If anyone can point me to the correct step in getting the "change of address " right the first time, I would appreciate your help.
