Married with a B1/B2 Visa Confusion, please help.

Hello everyone. My husband (an American Citizen) and I got married earlier last month. He went back home two weeks afterwards. As much as I want to be with him right this second. It is not feasible to do so,(he is still studying, finishing up his masters) so we had postponed to do the K3 Visa. The purpose of my visit is also to meet my inlaws (I had never met them)..My question is , the Embassy had granted me a B1/B2 Visa and its Type:R (I don;t know what this mean?) It is only for a single entry and the issue date is Feb 2006 and the Expiration date is April 2006. I am confused as to how many days am I allowed to stay in the US because it didn't say so on the Visa. I am very worried about this and would an open ticket be sufficient as an evidence of me returning home ?(to show that I have no intention to stay long term) Other than my husband I also have my best friend and cousin staying in the US .Well I hope that I can have some answers regarding this. Having a B1/B2 visa issued to you is not a guarantee that you will be allowed entry into the US. Once you get to the POE, you will have to prove that you have sufficient ties to go back to in your country of origin. An open-dated return ticket will only weaken your proof of intent to return to your origin country.

As to your question about how long you can stay, that will depend on whoever will process you at the POE. He/she can give you one month or 6 months. The expiry date on your visa is the last day that you can use it to enter the US. It has no bearing on how long you can stay in the US.

Thank you for replying so what is my best bet? A return ticket (dated?) would that be ok? I also have family back in Malaysia and they really need me to go home. What other stuff can I use as proofs? Prior to this I had lived in the states for 6 years (my dad's a diplomat) and I had also stayed in japan under tourist visa and did not exceeded their limit of 90days. Can I use that as proofs as well? Thanks..

I dont know this is tough. Definitely I would say have a return flight. Try think how long you want stay and perhaps try to buy ticket which you can change if you will be allowed to stay longer.

As was said on the tourist visa it depends on the immigration officer. Usually they allow you to stay for 6 months however they can give you a months.

If I were you I would not mention under any circumstances that you are married to US citizen. That would definitely would be a reason for them to turn you away because you really should enter under spousel visa.

Sept-21-2006 ~ EAD renewal approved 253 days

Sept-30-2006 ~ 2nd Biometrics appointment

June-18-2007 ~ E-filed yet another Work Permit and AP renewal :(

After 2 years, 6 moths and one day I have received this email:

Application Type: I485 , APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS

Current Status: Notice mailed welcoming the new permanent resident.

As any other visitor visa, you will need to show proof of ties to home country. Usually this includes lease agreement (if you maintain your own place), confirmation from your company on employment (if you are working & on leave), return ticket (dated), etc.
