This is my first post, but I want to share our story so far in dealing with quite possibly the worst department in our Govt. :help:

4/20/2007: Filed AOS thru DORA program in Dallas. Did the interview. Was prepared to file for EAD, but the man at the counter successfully talked us out of it, saying that we should wait to see because the if the AOS wasnt approved within 90 days, they would send us a letter and infopass appt for EAD filing. (We are now regretting not filing for EAD when filing for AOS.)

4/27/2007: I-485 received.

5/2007: received I-485 NOA (receipt) and Biometrics appt letter

5/29/2007: Biometrics appt

5/30/2007: last "touch" in online case status - Case status says case is at NATIONAL BENEFITS CENTER.

nothing heard, no letters, etc (never got a 70 day letter, never got an appt letter for EAD filing)

8/2007: after 60 days since last "touch", (and 90 days past filing) contacted NCSC and was initially told that I needed to make an infopass appt to speak with someone at the Dallas office. I walked the agent through the infopass website and demonstrated that there was NO option to get an infopass appointment for an in-person inquiry in my situation. I was then able to speak with an Immigration officer who said the case is sitting at the DALLAS office, and she could do is submit a memo? to inquire about the status.

After two weeks I got a letter thanking me for my inquiry but explaining that my case was within the "normal processing timeframe" whatever that means.

So here it is, November 1, more than 180 days past filing date (and outside of normal case processing timelines according to https://egov.uscis.gov/cris/jsps/officeProc...ectedOffice=22) and 60 days past my last inquiry.

I will be making a 2nd inquiry and also attempting to find out how to file for EAD, since I have no idea when the AOS will be approved (if ever.)

Any suggestions on other avenues I should be exploring are welcome..

Sadly you're not outside of processing time yet. You have to wait 30 days AFTER your date that they are processing on.

For example if they are processing the latest applications as of April 27th, then you're only 3 days out. You have to be 30 days out.

Call the USCIS phone number and ask if you are 30 days over yet. You can also do what I did and call and say you were told by someone last week to call to be escalated to a second level immigration officer. Worked for me. :)

Hello..I'm new here...I was wondering if you experience my situation..I filed my I-465,765 concurrently in Dec. 2007. RD12/11/07 . Today I just came back from an Infopass appt. It has been 96 days since my RD(I-765)and it is still pending. I was told by IO that USCIS required futher evidence(RFE) which I never received in the mail during the 96 days. Does anyone has this happened to them before?

TIMELINE

Dec. 7, 2007 mailed I-485,765,131 forms concurrently to Chicago lockbox

Dec 11 ,2007 RD I-765,I-131

Dec. 13, 2007 ND I-765, I-131

Dec. 24 ,2007 Appt for Biometrics

Jan. 5,2008 Biometrics completed

Jan. 8 ,2008 I-765 "touched" LUD

Mar. 10, 2008 I-765 "touched" LUD (day 89)

Mar. 17, 2008 Infopass appt. (IO called USCIS (Lee Summit)and told her that an RFE was sent) Date of RFE???

On a K1 visa...

A response is greatly appreciated.
