Last name change during AOS

Timeline

Hi guys. I've read everything I could find about last name changes, but nothing fits my situation.

So the situation is that my wife is coming to US soon on K-3 visa and all the papers so far are in her maiden name. Now, the question is do we change the name on AOS papers or wait until we get the green card. One thing to note is that she must get her SSN as soon as possible, so the approach we take must not cause any problems for that.

Any advice is highly appreciated! :)

I-130:

2007-04-02: Mailed USPS

2007-04-13: NOA1

2007-10-24: Approved!

I-129F:

2007-04-17: Mailed USPS

2007-04-26: NOA1

2007-05-11: Transferred to CSC

2007-06-07: Pending at CSC

2007-10-23: Approved!

2008-02-07: Interview passed!

AOS:

2008-03-09: Came home!

2008-03-13: Mailed AOS packet

2008-04-22: NOA1 for I-485, I-765 & I-131

I'd think about going with the I-130 [CR-1].

It may take a little longer for processing but she will get the GC WAY sooner than if she has to adjust status for the K3.

AOS for K1, K3s can take from 2 months [rare bird] to well over a year to get the GC.

CRs get SSN and Gc within a short time of arrival at POE. Like 2 weeks to a month.

Is MC in her maiden name also?

Thanks, but I read somewhere here that if you already filed I-129F, then to reactive I-130 (CR1) can take a while. Also I don't care about GC, all I want is for her to be in US ASAP! And since she will have a work permit and will be able to enter and leave the country, I don't care much :)

As a K3 you will need to file either the AOS papers or apply for a EAD on its own. It will take approx 90 days to get the EAD and then she will be able to apply for a SSN and work.

K3 is not automatically work permitted like the K1 on entry.

The AOS/EAD papers can be filed using the married name. To change later will cost more money and hassle.
