Hello all, I know it is a silly question , but it looks like my i-130 is moving quicker than I-129 F.

I was under impression it will be the other way around. To be honest with you , never thought about what I will have to do if my i-130 gets approved faster.

What do we do next?

Is it better than K-3 visa and than adjustment of status?Will my husband be eligable for green card sooner?

I look at piles and pile s of Q and A , I am confused. If someone could give me a simple outline, that would be great:)

The I-130 is better than the K-3. If an interview gets scheduled for this one first your husband will get his greencard after this interview. He will not have to do AOS or apply for EAD. I can't really give you an outline, maybe someone else will be able to, but I can tell you the I-130 is better than the I-129.

K3-once approved spenda a very short time at NVC just long enough to get a case number, then onto the Embassy/Consulate,where your husband would get the pack 3 pack 4 from, plus he would have to have a medical,( also he needs a medical for I-130), once in the US your husband would have to apply for EAD &AOS which can take a while before he gets a greencard!!

I-130 CR1-married less than 2 years=2 year greencard,you would have to have to lift conditions 90days before the 2nd anniverasary of the date on the card!!, IR1 married more than 2 years =10 year greencard!

The CR1/IR1 visa once approved goes to NVC where it will be processed i.e aos bill IV bill etc, this can take anything from 2 months to 5 months this all depends on you, and the efficency of the paperwork!,your husband would have an interview at the Embassy/Consulate, but upon entry in the US this triggers the Greencard in the mail, which takes anything from a couple of weeks to get in the mail!!

We did both K3 & CR1 visa's, got both!!- I returned to England for my CR1 interview after first arriving on a K3 visa!!

May/25th 2006- Green card arrives in the mail................YAY!!

19th June 2006 I Had to go to the Social Security Office to get my number, the DS-230 didnt work for me!!

26-June-2006- Social Security# arrived in the mail....YAY!!

Feb 2008 lift conditions <<<reminder to self!!<<<< went to England for a visit instead, no rush right, 90 days is a long time,LOL

I imagine whichever one is quickest is best. We decided not to bother with the I129f because i really need to work straight away rather than adjust. The I129 would have got us together sooner in hindsight but the work issue is important in our case. Good luck anyway.

23rd February 2005 Married.

10th May 2005 I130 packet sent to TEXAS forwarded to Cali.

12th May 2005 NOA1 Received date.

14th May 2005 delivered at 4:34 am LAGUNA NIGUEL, CA 92607.

23rd May 2005 NOA1 notice date.

27th May 2005 NOA1 hits the mailbox.

13th August 2005 po po form mailed off with £10 cheque.

2nd September 2005 po po letter arrives.

3rd September a 4 week visit to GA assuming i get allowed in.

30th september 130 days on I130 and counting.

(Hopefully i finally get a wedding ring today too)

30th November NOA2 date. woohoo

January 2006 case arrives at NVC finally(not sure about exact date)

17th February 2006 IV bill mailed back

21st April case complete (sorry i have missed some dates of forms going back and forth)

2nd May case forwarded to Embassy in London

10th July 2006 visa interview 10.30 a.m.

Our I-130 was approved first than our I-129F. We decided to move on with our I-130 rather than our I-129F as we figured out that the I-130 is better than the I-129F. You have your own option which way you want to go.

Essentially, the one which is best is the one which suits your purpose best. As has been said, the K3 will probably still get you to the USA faster than the CR/IR1. However, you will still have to go through the AOS process. The CR/IR1 will probably take a bit longer but you are all set once you have it, choice is yours. Good luck :)

Our I-130 was approved 1 week before our I-129F. We are still allowing the I-129F to process because we know that the I-130 can still spend months longer at the NVC. My husband will not adjust status but return back to Sweden for his interview so he can get his greencard sooner.

If the I-130 is approved first they will send it to the NVC. The NVC will send your spouse the DS-3032 for them to issue sort of a power of attorney (ususally you), and the bill for the I-864 to you. Once they receive the DS-3032 they will send the bill for the DS-230 to whoever your spouse selected on the DS-3032. Once they have recorded that you have paid for the I-864 they will send you the actual form. Once they have recorded the payment for the DS-230 they will send you the actual form.

Make sure to read requirements for these well in advance. you will need 3 years taxes for the I-864, a statement from your employer, and if you don't meet 15% of the poverty guidelines you will need a co sponsor as well. As for the DS-230, well that depends on the consulate. We sent all of the requirements for the DS-230, part 1 and 2 back to the NVC. Some consulates do it differently. The NVC scheduled our appointment for the interview, whereas some consulates do that themselves.
