I graduated this May and have my OPT until next June. OPT allows me to find jobs in the US legally. Unfortunately I haven't had chance to find a job which offers sponsorship (EDA). If I still can't find anything before April (start applying then and will fill up with a few days), I have to leave the US!

My USC boyfriend wants me to stay with him in the US, so he comes up a suggestion, let's get marry! I have been searching info about K3 and IR-1/CR-1. It seems that I have to go back to my country to wait for my visa during the pending period? Is anything can help me to stay in the US and change my visa status directly without leaving the US? such as my OPT or AOS???

If I apply K3 or IR-1/CR-1 before the expiration date of my OPT, do I have to give it up and go back to Taiwan?

VERY CONFUSED...

If you are already in US, I would say try posting the question in Adjustment of Status forum because it might be an option for you to stay in US & adjust status instead of going back to home country to wait out the process.

Jan 3 2005 : Petitioner received copy of DS 3032 and I-864 fee bill. Post-marked Dec 23rd.

Jan 11 2005 : Beneficiary received DS 3032 in Indonesia

Jan 31 2005 : Sent DS 3032 to NVC

Feb 8, 2005 : NVC received DS 3032

Feb 21, 2005 : IV fee generated

Feb 25, 2005 : Sent I-864 fee bill

Feb 28, 2005 : I-864 fee bill delivered to St Louis

Mar 3, 2005 : IV fee bill received

Mar 7, 2005 : Sent IV fee bill

Mar 9, 2005 : IV fee bill delivered to St Louis

Mar 28, 2005 : I-864 fee credited against case.

April 6, 2005 : Received I-864 package

April 7, 2005 : Immigrant Visa fee credited against case.

April 11, 2005 : DS 230 is generated

Aug 12, 2005 : I-864 & DS 230 received by NVC

Sep 14, 2005 : RFE on I-864

Nov 3, 2005 : Checklist response received at NVC

Nov 25, 2005 : Case completion

Dec 9, 2005 : Police Cert requested from the Netherlands

Jan 12 2006 : Interview success - Approved !!

Jan 19 2006 : Visa & brown envelope picked up

I got married during my OPT year and then filed for adjustment of status without having to leave the US.
