NOTICE OF DECISION

This notice is in reference to the Form I-129F, Petition for an Alien Fiancee (e), for classification of the beneficiary under section 101 (a) (15) (K) of the Immigration and Nationality Act, filed pursuant to 8C.F.R214.2 (k)(7).

Section 101 (a) (15) (k) (ii) of the Immigration and Nationality Act states:

has concluded a valid marriage with a citizen of the United States who is the petitioner, is the beneficiary of a petition to accord a status under section 201 (B) (2) (A) (i) that was filed under section 204 by the petitioner, and seeks to enter the United States to await the approval of such petition and the availability to the alien of an immigrant visa...

You have not submitted evidence with this petition to show there is a pending or approved Form 1-130. Additionally, U.S. Citizenship and Immigration Services' records do not indicate that a Form 1-130 is currently pending or approved.

Since there is not a pending or approved Form 1-130 petition, the petition is denied. There is no appeal to this decision.
