Hi guys

I'm married to american citizien and we both live in Israel. We want to move to USA. The problem is - my husband didn't live in USA for the past 10 years and can't be a sponsor. We don't have a ny relatives in USA that can be sponsors. Does someone know anything about situations like that?

You mean you can't go through direct consular filing (DCF) through the American Consulate in Tel Aviv? I found this webpage which details what you need to do and includes contact information. Check out the DCF-forum on this website for more information.

You mean you can't go through direct consular filing (DCF) through the American Consulate in Tel Aviv? I found this webpage which details what you need to do and includes contact information. Check out the DCF-forum on this website for more information.

The problem is that he cannot be a sponsor because he has no domicile in the US...

In this case, the USC spouse may have to go ahead and set up a domicile in the US before petitioning to bring their spouse to the US...

True, but that has nothing to do with the length of time he spent in Israel. The Consulate-website btw suggests just that, setting up domicile.

thanks for answering. but if he will need to work there for 3 years - because we've been ask to show domicile for 3 past years. so we can't move there for the next 3 years

No, you don't have to wait three years.

There was another couple in a *very* similar situation to you. They successfully immigrated to the US:

If not, search the archive of the DCF Forum for "Yovav". He is a USC who had never lived in the US and he was able to establish domicile from abroad and I think they completed the I-864 with assets.

Hey

If it helps to anyone - i found another option. In another forum. You can go with husband on your tourist visa and you say in airoport that you are coming to chek if you want to live in USA. ' cause you not sure. They let you stay for 6 months as tourist. When a husband find a job and after 3 months you apply for GC and EAD. Not to apply after you get there, cause they can think that you are scam :).Yu get EAD and after 2-2.5 yaers you got to intervew for GC cause husband can be a sponsor

Scora, don't do that. If you know that you intend to live there, it's visa fraud and illegal. You will also very likely be denied at the point of entry - they'd see straight through that one!

Trust me on this one, DCF is by far the better option for you.

I'll give you the benefit of the doubt that you do not yet know that your advice is to commit an illegal act.

All reported threads/posts containing reference to immigration fraud or illegal activities will be removed from this board.

Suggest you research what you read on message boards before taking it as fact and passing it along to the equally unknowing.

Ironically, the illegal way is a lot more work than the legal way that they have spread out before them.

it's illegall in case i know that i want to stay. But if i don't know if I want....what is wrong with it?

and what is illegal if I'm married to my husband and we want to live together in one country? what illegal in this?

what funny is that we got married in USA. So we could it it than. But we didn't, cause we didn't know if we want too. So i don't see any problem with it.

It's illegal having intent to immigrate on a tourist (non-immigrant) visa, Scora! That's what's illegal about it.

As Meauxna said, doing it the back-door, shady, illegal way is going to be more hassle to you than doing it all above board and properly.

Trust me, there's no reason we would be telling you not to do something because it was illegal if it weren't. We're not trying to make your life difficult, just prevent you from getting turned away at the border.
