6 months to start processing or finish??

Hi Everyone,

Does it take 6 months to START PROCESSING the case or to give APPROVAL?? Either way, a few of us are over the 180 days by almost a month now.. :crying: sorry if I keep complaining everyday.. just a little unfair... March people can come already... congrats March people... I was hoping to at least get her here by Christmas.. that was already giving a month's extra time.. but like what pushbrk said to just hope for an April interview.. That is what I had planned originally.. At this rate, she won't even come by April of next year.. :crying:

Their target is to complete the petition adjudication process within six months. There is not target for starting.

thanks pushbrk.. so what you are saying is that they should have approved (or denied) my application already? so I should have the right to start complaining now to them (not that it will make any difference though)... but at least for them to continue looking at my case... last touched was 10/25/2007.. still is this morning as of 10/30..

I don't want to be the possible bearer of bad news but you should be aware that the 6 months starts from the notice date on the NOA1.

The official wording on the NOA1 is "it usually takes 60-180 days from the date of this receipt to process this type of case". And, according to your signature that date is the 21st May. That means you are still a few weeks short of the six month processing time

My I130 NOA1 date was 25th April and the NOA2 date was 25th October (dead on the 6 months). So we know they are processing end of April/beginning of May cases. I sincerely hope you will have an approval sooner, but you should prepare yourself in case it is 3 more weeks until you receive it.

ok, thanks C and J... I called in and they told me they are basing it on the "official received" date, when they first received your I-130... that is so messed up.. I sent it in on 4/13, and they received it on 4/16... it's not my fault that it got entered on 4/27... then I got my NOA1 on 5/29... and that's why I sent the I-129F so late.. sent it in 6/4... got a 6/11 NOA1 date for that..

5/29 + 6 months ==> 11/29... wow :crying:

When Josh phoned the mis-information line after we "thought" our petition was over 6 months, we were told that it was still within normal processing times because our NOA1 date was April 25th (our received/priority date was 11th April, btw) . I'm sure the answer just varies depending on who you talk to at USCIS

Don't get disheartened it may not be that long for you, I just mentioned it so that you can be prepared should it take a few more weeks. I don't want to see you becoming more distressed Just keep that end of November date in your mind and an earlier approval will seem like a bonus.

I know if it was me I would prefer to hope for an estimate in 3 weeks with a good possibility of it happening, than keep hoping each day that an approval will appear and getting let down each day

So am I. This process is really, really frustrating. Gogo, you're past your 180-day mark, and I am sure you'll have your approvals soon! good luck to you. I am in the same boat, check my timeline. I've applied a lot l8r.

I was told the same as C and J. Although I've sent my petition in on 4/9/07, it took USCIS a month to open and input my data, so the date USCIS uses is 5/9/07.

gogo, I wouldn't worry too much about the date that they are counting the six months from. You got a bunch of touches in the last few days (not all from RFE trick calls I take it). It means that they are doing some work on your file. Didn't you post somewhere else that they said you had to wait another 30 days? I got the same thing. I called just as we hit 6 months for the received date (not the notice date) on the NOA1, a very nice gentlemen told me that my case was assigned to an adjudicator, but I had to wait 30 days to hear something (I asked if it could be sooner, but he said I had to wait 30 days). It took less than a week after that to get both approvals.

I was told too that I was within the normal processing times because they were using the notice date which was 3 weeks later and not the receipt date despite the USCIS website pronouncements otherwise. Good luck

I can't believe it is just waiting so long (I keep talking about the April vs March people)... 1 month later apply cost you additional 4-6 months time.. Again, congratulations on your approval!!! YAY!!!! :dance: ... at least you are out of USCIS... going into the world of NVC, but at least they are nicer...

Date Received in Mailroom – USCIS will honor the actual date that an application was received in our mailroom; this date will be indicated on the receipt (in the Received Date box) when Form I-797, Notice of Action, is mailed. You can see a sample Form I-797 under "Related Links" on this page. If your case is affected by the receipt delay, arrival of your receipt may take up to 12 weeks for adjustment-of-status applications and 15 weeks for naturalization and other applications.

Gogo and our I-130 NOA 1 took about 1 month to receive. Many other people received there NOA I in the 2 to 3 week time frame but, our applications were delayed because of the HUGE response for HBI work applications. Then computer problems and etc. etc.... You feel every turn there has been many delays....
