NOA2 case being forwarded directly to Embassy

Hello Everyone,

I'm sure most of us May Filers are waiting for our approved cases to be sent to the NVC so that a case number will be assigned and be then forwarded to the Embassy to where our Fiance(e) resides. I'm a little over 30 days now and NVC has not received my case and after reading that some cases were either being duplicated, lost, or put on storage it got me very worried. Last week I have mailed a copy of my NOA2 to NVC in hope that they can inquire the USCIS about my case.

I just got off the phone with USCIS and spoke to a very nice lady. She had told me that in my case my approved petition was forwarded directly to my Fiancee's Consulate in Vietnam. I asked her if she knew the date that it was sent out and she said from the system she can only tell that it was mailed directly to the Consulate instead of the NVC. If this is true, I will contact my Fiancee to ask her to go to the Embassy and pick up Packet 3.

I don't know if this is the case for everyone but if the NVC did not receive your case after the 3 weeks mark of approval I strongly ask everyone to contact their Fiance(e) and ask them to call the Consulate from their country to check and see if it was sent directly there instead.

Just wanted to update everyone I learned this morning. At this point it doesn't hurt to ask our Fiance(e) to check. I'll keep everyone posted.

This is the first time I hear of the USCIS sending cases directly.. and I'd be kinda doubtful about the info. this lady gave you... I thought the process for every case is to go through the NVC and then to the Embassy.

Why don't you ask your fiance to call the Embassy and re-check the info. they gave you? It wont be easy for her just to show up at the Embassy and ask for Packet 3. Maybe she can call them or email them.

The link you provided is for IMMIGRANT VISAS, keep in mind that K-1 is non-immigrant, so while the info. might be similar there could be differences in the process :)

Timeline

NVC assigns the case numbers before they are forwarded to the embassy. Yes, on the NOA2 it says that your petition is being forwarded to the consulate blah blah blah, but it makes a pit stop at NVC first. Thats why they are only at NVC for a couple of days.

This is the first time I have heard of them forwarding straight to the embassy.

The link you provided is for IMMIGRANT VISAS, keep in mind that K-1 is non-immigrant, so while the info. might be similar there could be differences in the process :)

Many consulates treat K visas as immigrant visas. London, for one, sends all K visas to the immigrant visa (IV) unit.

I am absolutely 100% sure that my letter says that my case have been sent to the NVC and that any further contact from this point on will have to go through them. I've read that letter many many times. :lol: But I will check again tonight. I can only hope that what the lady said was correct. I will find out soon enough (tomorrow) because I've asked my fiancee to go to the Embassy to check. Will keep everyone posted.

I think there was another VJ member that have posted this same scenario, in that his/her petition was also mailed directly to the Consulate. But I agree with you in that I thought this was a standard procedure that the approved petition has to be sent to the NVC first so that it can be assigned a case #. I will find out tomorrow.
