I need some advise...

I think my wife used me to get her green card. She has her AOS appointment in a few days. I am out of town and asked that it be rescheduled for when I am home but I don't think she did it. Can she attend the AOS appointment by herself or have a friend take her? She decided at the last minute that she didn't want to come with me on my trip. We had to cancel tickets and everything. She has been doing many other things that have made me wonder, but this one tops them all. I do not want to be vendictive as I do love her and want the marriage to work. What are my options if this was indeed her plan? Your advise is appreciated.

05/21/2004 - Mailed K1 packet to NSC

05/24/2004 - Packet received by NSC

05/27/2004 - NOA 1

07/19/2004 - 07/25/04 - Spent 2 wonderful weeks in the Dominican Republic with my future wife.

08/17/2004 - NOA 2 via email WE'RE APPROVED 89 DAYS

09/07/2004 - NOA 2 via snail mail.

09/17/2004 - INTERVIEW DATE - OCT 28, 2004!!!

11/08/04 - Arrived in United States!!!

01/07/05 - Married in Las Vegas

If she attends the interview on her own she will not be approved for her greencard.... you MUST be there...

From their timeline, it looks like this interview is for removal of conditions, not AOS as the OP stated.

I'm the USC.

11/05/2007........Conditional permanent residency effective date.

01/10/2008........Two-year green card in hand.

08/08/2009........Our son was born <3

08/08/2009........Filed for removal of conditions.

12/16/2009........ROC was approved.

11/05/2010........Eligible for Naturalization.

03/01/2011........Separated.

11/05/2012........Eligible for Naturalization.

Even if the interview is for removal of conditions... unless they are divorced she will not be able to lift the conditions alone...

I think it would be kind of crazy after going throug all this process together you won't go to this important interview you have to be there and the smartest decision would be to reschedule . :thumbs:

I wanted her to reschedule but I'm not sure if it happened. She doesn't know that I have to be there and if she goes on her own and tries to do this then it will prove to me what I have been thinking.

And yes, it is for removal of conditions. My brain space.

If she was a scammer and you had a good relationship so far, I do not see why she would persist on going to this interview alone. It makes no sense that somebody trying to take advantage of you, would not learn the immigration rules first and act according to the rules.

May be she is just anxious to have the interview done and over with? Why didn't you change your plans to be able to go to that interview together?

Anyway... if you love her, your only option is to be supportive and kind, otherwise you may risk to turn away a person who married you for real. Following that scenario you will find out the truth soon enough.

Your other option is to try and have her deported (which may or may not work). BUT, what if you are wrong and she does love you, eh?

It´s interesting...looks like she doesn´t even know...looks like you don´t communicate very well with your wife...maybe sometimes people should think about how to fix their marriage stuff (and maybe seeking someone professional to talk to) instead of going for the "I think I was used for a green card"...people have marriage problems all over the world and maybe it has nothing to do with a green card...talk to her and you will see :)

No offense, but if you two have been married for nearly 3 years... just seems odd to suspect her of using you, especially since you are talking about lifting conditions (not Green Card). Instead of entertaining suspicions about her intentions, why not talk it out in counseling? Without concrete evidence that you could report her for, what else can you do about it?

Sure. But that could be enough to make USCIS question the validity of the marriage.
